Ok so I entered my trust deed over5 months ago and I've still not had a notification posted in the Edinburgh gazette ? Is this normal as far as I'm aware as soon as it became protected this was just course !
Hi Mel,
From the 28th November 2013 onwards it's no longer a requirement to place a notice in the Edinburgh Gazette. Instead a notice is placed on the Register of Insolvencies. You can find a link to this register on the Accountant in Bankruptcy website where you can check your details.
Normally your relationship manager would keep you up to date with the progress of your case and if it has become protected. You should have also received a copy of the proposal which was sent to your creditors.
I'd suggest giving your relationship manager a call for an update on your case.

Welcome mel79.
To add to David's comments, the Edinburgh Gazette wasn't used to advertise that trust deeds had become protected.
An advert was placed there after you signed your trust deed, partly to give forgotten creditors the opportunity to come forward and have their say on whether the trust deed should become protected.
It's a thing of the past now though.
Well I can't seem to find my details on either at all ?! I wasn't happy about the company being taken over without being told till after the fact, I was told when I signed up for the trust deed it would be public on the gazette i signed my trust deed end nob 2013 with kelsom who have now been taken over by Knightsbridge. Also still getting letters from debtors ๐
If your name is not on the register of insolvencies then I suggest you speak to your trustee to find out why not.
Or it is possible that there may be a spelling mistake which is why you are not showing up on your search - maybe try searching by address instead?
Hi,
I'm not comfortable with the fact that Kelsom changed to knightsbridge just after I signed my trust deed in December
I've had lots of problems contacting them.
I just checked the Reg of Insolvencies and I'm on the part that says notification has went out to my creditors to object to the TD, however I'm not on the section confirming that my TD is protected. The original notification went at the start of February and I believe it's 5 weeks that they have to object or your TD becomes protected,
I'm concerned that's it been about 12 weeks and I haven't heard anything about becoming protected.
Is this normal practice do you know Kevin, I've paid in 5 payments now. Should I be paying into it if my TD isn't even protected yet?
Thanks.

Hi shark01,
Are you still having no luck speaking with them regarding your Trust Deed? I can understand your frustrations if you are not able to speak to someone regarding your case and if it's protected or not.
Under the legislation the Trustee as soon as reasonably practicable after the expiry of the 5 weeks in which the creditors have to object to the Trust Deed proposal must send to the Accountant in Bankruptcy the paperwork to have the Trust Deed registered as protected. This needs to be done within 4 weeks of the expiry of this period so it would now appear that the Trustee is out with this timeframe.
If this hasn't been followed by your Trustee then the AIB could reject their protection application and request that your Trust Deed is re-advertised.
I think you really need to get onto Knightsbridge and demand an update on your file. I would contact them on the phone, send an email and even a recorded delivery letter to ensure that you receive a response. Keep on at them.

Hi David,
I've just called their 0845 number that others have suggested I call and I get the usual spiel from a call handler who says there are no up dates yet and that I've to call back.
She didn't even ask me any security questions.
I asked to speak with someone more senior and they said they will get someone to call me back which I doubt will happen.
I am right in saying that 4 weeks after the 5 week expiry date for creditors to object the whole thing is invalid. My 5th payment has just debited bank account today, I'm really concerned that this isn't going anywhere. Have I lost this money now?
I either want to move trustee or be left witnmy creditors again, this hasn't been as stress free as they claimed it would be.
Hi shark01,
No, when you sign a Trust Deed it is legally effective and binding on you and doesn't become invalid in the way you have suggested. Once you sign the Trust Deed the Trustee then completes the requirements to have the Trust Deed registered as protected.
It's a difficult position to be in and it's experiences like this than can put people off considering a Trust Deed to help them become debt free. Really do keep on at them and ask to speak with that senior person instead of waiting on a call back from them.
In terms of the payments you have already made, if your Trust Deed eventually does become protected then these will count towards your overall 48. If there has been a problem with the Trust Deed proposal and it's not going to become protected then the Trustee may use the money you have paid towards their fees and costs of the Trust Deed to date.

Irrespective of a company being taken over, there should be some system in place to at least find a person to provide an update. The problem is that the Trust Deed works on time limits and if these are not adhered to, the the process needs to start again.

ok so im now 9 months into paying I have asked for copies of the trust deed and anythign that shows the details of creditors etc and after 8 requests now nothing has been sent, I have asked to speak to my trustee significantly more times than this and as yet I have still to hear from him.
I am being made redundant at the end of the month and being given a redundancy settlement, i forwarded on details of monies I would recieve and asked if i may be considered for early repayment and they told me that they still dont know the full value of my debt as some of the companies havent responded to them
I have heard nothing back from them in regards to what they think is a reasonable lump sum to complete the trust deed to say ive had mental health issues is an understatement in 6 years working for the company im with ive had about 28 months off on long term sick periods
i dont want to go back there again its a horrible place to be and it affected my children particularly my eldest significantly he spent 6 months being in constant pain being unable to walk and this was concluded to be stress induced !!!!
please im at my wits end with this company i am so dissatisfied its unbelievable ๐
Hello mel79.
It must have been really tough dealing with all of this while you have been unwell.
Some parts of a redundancy settlement might have to be paid into your trust deed, the statutory element will usually be yours to keep. Do you know yet how much you'll receive in total? Do you have a breakdown of the different elements of the payment?
Approximately how much did you owe at the start of the trust deed?
Are you still unsure whether your trust deed became protected?
ok so initial debts were 13k give or take some companies i hadnt heard of in years so making assumptions based on credit file and last known amounts, the agreement was 4 years 171 a month
accountant in bankrupcy have confiremd i am on the register as being in a protected trust deed
just downloaded my credit file there and one of the accounts for 1,600 is showing as satisfied and zero balance
another account seems to have been sold on again to another company who are fully aware im in a trust deed because they owned another of my debts is this legal to sell protected debts ?
the amount showing as default amount is showing as ยฃ1.70 im assuming they made a typo but does this error in their data not mean they can forfeit the amounts also ?
and the most interesting this and im assuming the trust deen company entered this onto my credit file is that the date in the public record information shows my trust deed satisfaction date as 29 november 2016 which is in fact 3 year trust deed and not 4 year ??? again what does this error mean for me when im expected to pay a further 12 months payments after this date ?
my severence package is the stat 3k (almost) plus and additional 9k
i was hoping that a reduced settlement figure somewhere in between the original outstanding and final settlement would be amenable to everyone but now having read my credit report i am even more confused ๐
