ppi refund in someone elses name

Hi
was hoping i could get some advice. I have been offered a ppi refund of nearly £5000 and i realise i would have to disclose this to my trustee. The issue is I also owed a family member a sum of money which obviously couldn't be taken into account on my trust deed. I have had this refund checque made out to this family member by the card company. Where do i stand with my trustee as i never actually received this money, went straight to someone else.
Any help would be much appreciated, thanks

Hi tucker

You would be illegally transferring funds which belong to your trustee to another party and in turn, your trustee would raise legal action against the family member ( and you) for this.

Can I ask why the debt to the family member couldn't be taken into account on the Trust Deed

Hi uncleben

They can with sufficient proof. Only exception is debts to spouses as these are postponed debts and only get paid when all others have been paid.

That kinda makes it pretty clear. Will call them in the morning and try to stop the payment, otherwise will get the third party to disclose and send funds on.
