just concerned by it all, I am with kpmg. Would just like to know what would be the wort outcome of it all. Any help s greatly appreciated.

If your trustee is made aware of the payment and the payments to your family he could decide not to discharge you until you had repaid the full sum or raise an action against the members of the family who had benefited from the payment.

Generally the funds should have gone to the trustee if he is not discharged.

Yes Heather.

There will be records on bank statements that he can review if he chooses to.

The scenario may be unearthed by the PPI claims firm as well.

Hi heather, I only started getting concerned about this when I received a letter yesterday saying that before we discharge you, you may have been mis sold ppi, I genuinely thought last September I was discharged from my trust deed.

Since I have been with kpmg during my trust deed not once have they asked for bank statements.

Sitting tight and seeing what happens is not a good bit of advice in the slightest. As soon as your trustee appoints a claims firm to look into ppi they will quickly discover that a payment has already been made and that is a serious breach of the terms of your trust deed I am afraid.

Contact your firm before they discover this,and try to work out with them a way to sort this. Burying your head in the sand is not likely to result in a good outcome.

Hi Paul,
I just want to do the right thing. We have only ever paid very little into he trust deed due to my husband being made redundant, we only made 4 payments. I have a low paid job so we didn't have enough surplus income. Our situation now is my husband receives no benefits at all except for housing benefit. I am currently undergoing treatment for cancer and on ssp, which is ยฃ85 a week so I have no way of paying it back anyway.

I think the best you could hope for is to talk to your trustee about bankruptcy by the money from the ppi may still be an issue even then. It could be seen that you have had an asset and moved it to avoid paying creditors (I assume theres no paperwork trail for the family loans).

Hiding away wont sort things. Take action yourself as there are always things that can be done.
