Hi everyone
I made a complaint to a company for missold PPI. They upheld my complaint and agreed to me an offer, but they say that it will be deducted from outstanding arrears.
I was discharged from TD in Oct 2008, surely they I am entitled to this money...
Can anyone help??

We cannot give you legal advice on entitlement.
A number of lenders/PPI sellers are adopting the same position.
You could take legal advice or escalate this to the Financial Ombudsman if you wish.
Thanks for your reply TDA. I had 3 accounts with this company and one of the accounts was closed before I entered TD and they are still using PPI claim to pay towards debts... Doesn't seem right.

I wonder if the accounts are with RBS as they seem to be offsetting payments against balances. Its a bit of a hot topic at the moment and hopefully it will be resolved soon.

Mark is not posting regularly in the Trust-deed.co.uk forum.
It will only be resolved surely after someone goes to court over it. Cant see companies paying out unless a test case comes about,even for people who have been discharged for a long while.

Hi. If you have a balance on a secured loan whilst in a PTD and you get awarded a PPI claim & they offset against the balance....do you still have to pay monies back to your trustee?

You wont have got any money though if they offset it against the remaining balance,so you wouldnt have any extra to pay to trustee?! If I have understood you correctly that is.
