I am fed up.
I paid my final payment August of last year.
The Trustee has appointed someone to check out PPI.
I told him that I had not taken out PPI with any.
All creditors have responded, with the exception of one.
No PPI was realised from the others.
A small amount of wrongly charged interested was recovered.
The remaining company appears to refuse to reply and the Trustee wants to contact the ombudsman for advice.
The sum involved with that credit is ยฃ1500 less one year's payments. Even if they wrongly applied PPI (remote) what is the sum risk likely to be?
I have asked for Form5 to be issued but the Trustee says he cannot release me and risk being 'sued/charged' (or similar wording) by the creditors.
I have asked several times since August but not received a positive response.
I have committed to returning any money sent to me, however, he does not wish to rely on that commitment.
Based on the above, I calculate the risk factor as negligible.
I feel frustrated. I know it is his decision, but I would really like to close this chapter, and move on correcting my credit record.
Any ideas? Or am I destined to wait until Trustee, PPI recovery firm, creditor and ombudsman get round to dealing with it :-(.
Thanks. Just looking for inspiration.
From what I understand your trustee can discharge you but remain in office to chase up PPI. But depends when you took out the deed . From my humble opinion you trustee is milking you for fees hopefully a expert can set you on the right course to getting discharged . Out of interest what is the firms name , maybe someone from this firm looks at this sight and could clear up things for you . Just hope its not Begbies Traynor , they should be a dairy[8)] rather than anything else .
Hi Firewalker.
A lot of trustees have concluded that they can discharge their clients in these circumstances.
They don't have to though, and its a shame that you're stuck with one that will not.
I wish I could offer something more positive but in the circumstances you might have to be patient.
Hi Pinalta
I understood the same about discharge and raised that but he has chosen not to and as TDA wrote, it is his choice.
I am not sure what you mean by him milking me for fees. I completed the trust deed with the payments I agreed at the beginning and I do not pay any more. Last payment was in Aug 2012. If he is milking fees, it is not from me.
I don't think naming them here would help any to be honest? It might just annoy them when they probably believe they are following the rules/procedure. Am I wrong in this thinking? I have written and called and raised all the points, and that was the response. It is not Begbies and Trayner and I deal directly with the Trustee.
I kind of suspected I will just need to be patient. I think I just wrote out of frustration and disappointment in case anyone had any ideas.
Thank you - and for replying at this time on a Saturday evening :-).
It seems really unfair that you should be left in this position through no fault of your own. All I can suggest is that you keep on at them and make yourself such a pain in the backside that they decide to discharge you just for a quiet life!
