PPI Claims and Trust Deeds

in my own circumstances my trustee has told me that he cant discharge me until PPI claims are finalised, as i could cash the cheque and keep the money myself.

surely if they are making the PPI claims (i had no notice that they would be doing this until after my final payment)the money would go direct to them.

all pretty daft really as all the companies have got back to me and told me i didnt take out PPI. so who knows whats happening now?

Hi andy.

The problem is that the change in the rules meant that a trustee can choose to discharge someone and carry on in office to deal with a PPI claim. It doesn't mandate them to do this though.

I therefore am not sure that legal action of any sort would assist you right now.

I don't think legal action would help - though there is no reason you couldn't raise a complaint with your trustee's professional body, andy

Hi Kevin,

I can't really see any action coming from that I'm afraid. Just feel that the trustee can do whatever they like with no protection for people.

I applied for a job today and the women said they would run a credit check for bankruptcies/insolvencies etc. I explained that i did have a trust deed but it was paid up in January, but i've not been offically discharged yet. So she said she couldn't take the application any further. I wish now that i had just went bankrupt, at least you get discharged after a year.

Given your experience andy I can understand totally why you would feel like that.

Most trust deed firms do a really good job of getting people discharged within a few weeks after completing their responsibilities.

It's a great shame that the same few firm names keep cropping up where prompt discharge of clients seems to be of no importance whatsoever.
