So much for a potentially smooth discharge[:(!].

I had emailed my trustee when I got the letter asking if I objected to them pursuing PPI claims. I objected as I asked for every bit of PPI I had on my accounts. This morning, I get a pack through from a company called Equity In Finance with forms for all my accounts to reclaim PPI. I can see an annoyed phone call to my trustee on Monday. I got no reply to the emails I sent them. I can see my discharge taking months longer because of this.

Nothing left to discharge - everything's done and dusted!

Contact your trustee and inform them that it would be illegal of you to make a fraudulent claim when you knew exactly what you were getting.

RSM Tenon sent me a letter out,I phoned my case manager and told her that I never took any ppi and that was an end to it.

I would be more than raging if discharge was held up due to this.

NOT ALL PPI WAS MIS-SOLD!!!!

Paul is correct, not all PPI was mis-sold. The claims are only for the mis-selling, so if you are quite happy with the PPI sold to you, tell the Trustee & Equity in Finance, and that should be the end of it.

Hi I was wondering if anyone can help me . This morning I received a pack from my trust Deed company.. They want to pursue a PPI claim on my behalf. I paid off my last payment to them approx three years ago. How long do they have control of my finances please. I was thinking of claiming PPI myself.

I don't see how they can claim PPI if you were discharged 3 years ago. Yes, they may have been entitled to it at the time, but once the Trustee is discharged and funds paid out, I don't see how that could work. I will be interested to hear what Mark & Kevin have to say on this. Simple answer would be not to sign the forms. They are often sent out as standard practice, as the company will not know if it has been mis-sold or not...only you know the answer to that.

Dont sign anything,you have been discharged so its nothing to do with your trustee.

Some companies keep records of debt write offs so I wouldnt even attempt to reclaim mis-sold ppi if you have ever been declared insolvent as creditors may attempt to offset the ppi claim against the write off.(not sure about for active trust deeds).

Hello wyttchie.

Just to confirm, you have received confirmation of discharge from your trust deed?

In terms of claiming PPI yourself, be careful if the accounts were included in your trust deed. You're unlikely to get anything back.

Well, that was relatively painless. Just spoke to the person who was dealing with my trsut deed. The said that they had a duty to investigate PPI claims but that it wouldn't slow down my discharge. I could still be discharged but have my case open to allow pursuit of claims. I pointed out that while I accept there was a fair bit of miss-selling going on, I didn't believe I met the criteria due to asking for all my PPI, would it not be fraudulant of me to sign a document saying I had been miss-sold. He agreed and said he'd inform equity in finance of this so not to fill in the forms. He'll phone back to let me know this has been done. Hopefully that's it back on track now.

It would be great that if the industry standard for this now would be to deal with this at the start of the trust deed. You get asked plenty of quetions in the interview part so I don't see how it would be difficult to tag this on.

Thats part of the problem,there are so many differences on how trust deeds are advised upon and run and closed,the industry standard for certain things does exist but even then different companies appear to have differing takes on what looks like black and white issues.

It should really be getting dealt with at the start of a trust deed,and certainly not left until the month before your final payment is due!!

I still have a problem rationalising a trustee charging a fee to pay a fee to a company who will chase money from a creditor to give to the trustee who will return a smaller portion of the money back to the creditor.

Newbie, I would call them as well. I emailed my trust deed administrator twice and emailed the company once but got no reply. I had wrongly assumed that would be the end of it. Now they have a very clear understanding of my objections.

Hi gillian.

The net effect of such claims will be that creditors who were "up to no good" in the way they sold PPI will subsidise higher dividends being paid to creditors who didn't misbehave on PPI.

I think that's a good thing, but it should certainly be done early in the process in my view.

Great to hear your firm will discharge you and keep your case open to look into the PPI side of things. If only every firm was taking the same approach.

Hi...Im really confused and I need some advice.. I phoned up my Trust Deed poeple who were dealing with myself....I paid my last payment in June 2009..but they still havent discharged me..they are saying that they will need to send someone out to value my flat to see if I have any equity...what happens after that?.. I recently retired from the N.H.S.I received my pension and my superannuation which I have banked in savings. I am frightened that they can touch my savings as this is for my retirement...can anyone give me some advice.

What firm did you use for your trust deed Wyttchie? Was equity ever discussed at the start of the trust deed process??

Seems a long time to wait to get discharged.
