Hi

Can anyone advise whether it is possible to claim for PPI compensation after discharge from TD?

Cheers

TS

Hi tinsoldier

It would require the Trustee to be discharged as well as yourself.

I think there would be arguments for and against as the debts should legally die on discharge, but mis selling may stand outwith this.

My advise would be go for it and see what happens.

Thanks.

I was discharged nearly a year ago, shouldn't the trustee be discharged also?

My argument would be based on the fact that without missold PPI there might not have been as much debt

I imagine your trustee will be discharged too - although you should check first as often trustees are remaining in office to deal with this very issue.

I think your argument stands to reason, so as Mark says you may as well go for it. However, be wary of using a claims firm to do the work for you as you could find that your creditors merely offset the payout against the debts and that you are left with a bill from the claims company.

How can I go about checking if trustee is discharged?

How can creditors offset payment against debts that now legally don't exist?

I'm not sure that they legally can, tinsoldier - but that doesn't mean that they won't try and you might have a fight on your hands to persuade them otherwise.

The Register of Insolvencies has the date of trustee's discharge, which can be accessed via the Accountant in Bankruptcy's website.

Hi tinsoldier,

I have been discharged for nearly 3 years now and have been trying to claim back mis-sold PPI. I had a successful claim from one bank who were part of my TD, once in TD they sold debt on, they upheld my claim and paid the rebate to myself. As yet my other claims are still being investigated. The one issue I have had was when I sent a SAR to Tesco for a cc I had that went in to TD they sent me staements for this year with an outstanding balance at a 0% interest rate and no charges on it. I was shocked to say the least and wrote a very strong worded complaint to the CEO's email addy and sent letters in post to both head offices with proof of TD and discharge, they are still investigating. A couple of CC's have turned me down, claiming back PPI if you made an online application is harder as you have to physically tick the box (some CC companies had this box pre ticked, these claims are usually upheld). Good luck claiming, it is a long process but an easy process, don't go via a claims company, you can get standard template letters from MSE or ConsumerAdviceForum, there is loads of helpful guides on these websites.
