Glad you're feeling a little better lorrainek.

Please don't allow this PPI thing to trouble you too much when other things are so much more important.

Speak to your trust deed firm when the chance presents itself though; I do hope they'll help you to sort this out. They may feel they need to get involved if there is money "due" from the bank now which could be a good thing all round.

lorrainek - so sorry to hear about your father, money issues seem rather insignificant considering the week you have had. If there is a PPI payment, and the bank off-set it against the money they are due then in normal circumstances that is ok. However, if this happens when you are in a Trust Deed, the Trustee can request the funds be paid to them in full - normally thhe bank will do so if requested as they know that is what should happen anyway. The bank have agreed that PPI was missold, if you are in a Trust Deed they cannot choose to put themselves first above other creditors, although they often try. Tell your Trustee, it only takes a letter from them to have the funds paid to your Trust deed estate. This may be of help to you, as even if the Trustee keeps it all, they may allow you a break in payments to fix your heating. I am sure something could be worked out.

riddock2016 - KMPG do pursue PPI through Trust Deeds, so I am sure they will find out about your windfall, when the bank tell them it has already been paid out...and when! Better to tell them or you could be in hot water. They are more likely to look kindly on you if you ahve been honest.

That sounds very helpful, I only wish I had read the advise about claiming ppi on the forum, what about the fee the company will be looking for which i dont have will the trustee be willing to pay this, this is probably my biggest worry now.

They have discretion on that lorrainek.

It probably is a question of asking nicely and hoping they choose to help.

Hi,

spoke to trust deed today, feeling much more positive about things today. Also my December payment is going to be reduced so that I can pay for central heating repair.

Going by recent winters the central heating fix is a must!!!!

We are at the stage of the last payment of my hubby's TD being made in January and just received a letter for TD company about possible mis-sold PPI and they are appointing someone to check this out. The only loan we think we have potential missold PPI on is in joint names and not part of the TD. How would this work? would I get half of the payout and hubbys half to the TD or will it all go to TD. Not even sure we qualify yet

If you arent in the TD and the loan was joint then you should get part of the ppi,although as it wasnt included in the trust deed(I assume you carried on making payments)I am not quite sure how this works,clearly hubby would still be entitled to make a claim,I got the same letter today from tenon.

Thank you Paul. Are you near the end of your TD too? You are right we have continued making payments. We will wait and see the outcome. I am sure it will get sorted eventually, finalisation of the TD may just take a bit longer

We have just 1 payment left each(wife and I have separate TD's running side by side),just keeping our heads down trying to avoid anything breaking and so far dogs needed an op and wifes car needed a repair in the last 2 weeks,xmas is cancelled here,well scaled down at least!!!

Its been a learning curve to say the least.

Update,

I hopefully have managed to sort the PPI, the bank who I claimed from cannot take their share, it has to go to the trust deed, also the company that claimed for us cannot pursue payment, i just need to prove to them we are in a trust deed.So it is all looking very promising, which is a huge relief

A PPI advisor came to my work a couple of weeks ago to go over forms etc. It was looking really promising for re-claiming 4 old loans however I called them yesterday to cancel the PPI claim, kinda felt sick but at the end of the day, the trust deed is a massive step towards getting my life back on track and a couple of grand pay out wont make much difference in the long run.

Paisley you will probably find that your chosen insolvency firm will want to investigate if there is any chance you were mis-sold ppi and reclaim it on your behalf(usually through a 3rd party),although you wont see a bean it all goes to creditors minus the dreaded fee!!!
