We were released from our Trust Deed 2 years ago with all PPIs settled, recently we received a letter from BOS saying that they have changed their original decision from 2013 & recalculated their offer. They are sending it to the company who were dealing with deed, what do they then do with this money when everything is settled?
Hi sandie72
It will all depend if your Trustee has been discharged. Do you know if they have been discharged also?

Welcome to the forum Sandie72.
It seems that there are two likely outcomes:
1 - The trustee has no interest in this payment and forwards it to you.
2 - The trustee seeks to "re-open" your trust deed to capture these funds for the benefit of your creditors. We think it's only one firm doing this currently (we're not sure which firm it is). It's important to note that you will not be in a trust deed again if this happens - it would just be the trustee getting reappointed to do the work they'd need to do.
Thank you for your replies, no idea if they were discharged also...tried searching "Register of Insolvencies" but unsure of all the dates so no entry coming up. Maybe just a case of wait and see if we hear any further.
Does your name not come off the register until after the trustee has been discharged?Reason I ask is because I myself was discharged over 2 half year ago but my trustee still remains in charge. There was a delay on chasing PPI when The RSM tenon issue happened and my account was transferred to apex debt solutions but I would have thought this would have been resolved by now because I want my name off that register as soon as possible
Welcome to the forum Hibeeguy.
I'm afraid you're correct. Removal from the Register of Insolvencies occurs one year after your trustee is discharged.
This might not be any compensation, but this doesn't change the fact that your trust deed will still drop off your credit file six years after it began.
Thanks TDA,out of curiousity does anyone from Apex post on this forum?without name dropping I emailed my trustee over a month ago on 2 occasions and haven't heard anything back.I appreciate them
Remaining in charge has no effect on me but until I see them
Discharged I won't fully be able to move on.I emailed my trustee just to say that I had received a couple of letters from my creditors regarding PPI and that there investigations showed that there wasn't anything to pay out,I just wanted to know if they received the same letters or if I was to pass them over to apex.
Hi Hibeeguy.
There's nobody from that firm actively posting on the site, but we know that they've taken an interest in reading the forum in the past.
They might have received the same letters as you, but I'd send them in anyway just in case. As they're confirming there's no PPI to claim they might just assist in bringing this process to an end sooner.
