Hi it says on the ROI
Date of trustee discharge 04/04/2014
Date of debtors discharge 22/01/2014 does that mean we are discharged

Looks like the money is yours as both discharges are registered. Great result.

Thanks for the kind words mags67.

Debtors discharge = you've been discharged.

Trustee discharge = any PPI claims money is almost certainly not going to the trustee.

Well the outcome is we are getting the MONEY (Hurray) minus the fee for the investigation of the PPI which had previously been denied thanks again for all your help and support over the last few years One Happy Bunny ๐Ÿ˜€

That's great news. I'm sure the extra money will come in handy!

Can I just ask, when you say minus the money for the investigation, who is deducting this, is it your previous Trustee or did you use a PPI company to investigate it?

Hi David its our previous Trustee not sure of all the details just glad we getting the money ๐Ÿ™‚ and Trust Deed Assistant much needed DIY in the house and a couple of treats ๐Ÿ™‚ thank you again

Hi mags67,

I would question your previous Trustee and ask them on what basis they are entitled to retain some of the compensation for their investigation fees.

It sounds to me like they tried to investigate PPI, didn't have any luck or receive any compensation whilst your Trust Deed was live and the Trustee was still officially in charge and therefore decided to completely close off your case and seek their discharge. This should only happen when the Trustee is satisfied that all assets have been realised and all funds ingathered. Now all of a sudden there is PPI money available and they decide that they are retaining some of this for their fee.

If you can find the time to question this there might be a chance that you get all of the money. There may be a valid reason for it but there is certainly no harm in asking them about it.

I have read with interest Mr MacFadyen note on discharge, I currently have an issue with my previous Trustee "Clear Debt Ltd" , despite having it confirmed by AIB that both myself and my Trustee were discharged in Jan 2012, the Trustee has informed my bank that's PPI monies are due to them, the banks will not release the monies to me unless they have a written letter from the Trustee confirming he has no longer any interest.
Despite letters and telephone calls to there office from DEC 2014 to-date I still have no response from my ex Trustee.
Are Trustee firms accountable to any UK Organisation where you can raise your grievancies against there conduct ?

All insolvency practitioners are licensed by one of the professional bodies. If you still have some paperwork from your former Trustee you should be able to find out who their professional body is (usually under their signature)
