Hi
We were discharged from our TD last February and have recently received a letter from the Halifax regarding PPI they said they had sent a cheque to the company which dealt with our TD we telephoned and they had said cause we were discharged it was nothing to do with them anymore and would sent a letter back to the Halifax saying that, we then received another letter from the Halifax telling us we would receive the cheque in 10 days. Today we phoned to ask why we hadn't received the cheque and were told that the company dealing with our TD had phoned them and told them to send the cheque there haven't been able to speak to the company as the person dealing with it is off today looking for some advice here as this doesn't seem right [?]

it sounds like your discharged from your trust deed but your trustee hasn't discharged you yet. It means your no longer liable for your previous debts but all your PPI is due to your trustee. Let them have all the PPI, it means the trustee is more likely to discharge themselves from your case and you can get on with your life.

Hi mags67

Unfortunately no, as the whole thing depends on the Trustee being discharged. While they remain as Trustee, any PPI would be paid to them in full for the benefit of creditors.

Hi mags67

It's certainly strange. If the ROI shows both you and the trustee have been discharged, then the payment will go to you. Even if they were not discharged, i wonder if the letter alone would be sufficient to make payment to you!

You'll need to visit the Register of Insolvencies and look up your case mags67.

You can access it online via the Accountant in Bankruptcy website (registration required).

Your file on the Register of Insolvencies will specifically tell you whether you and your trustee have been discharged.
