Power of Attorney while in Trust Deed

My parents are considering giving me Power of Attorney while they still have all their faculties. I understand that you cannot be given Power of Attorney whilst in a Trust Deed. The last payment to my Trust Deed is due at the end of this month. From this forum the Trust Deed should finalise in 6-8 weeks. Once the TD is finalised would I be able to take on the Power of Attorney role for my parents or does a further period of time need to pass?

Hi Matt65.

There's no fixed period that your discharge will take, it varies from firm to firm.

However, once you've got your Form 5 and the discharge has been recorded on the (online) Register of Insolvencies you're finished with your trust deed.

TDA is correct as any restriction for a continuing power of attorney are lifted when you are discharged not the trustee.
