Hi Mark ,
Thanks for your quick reply, I did meet with a scottish based company Right Debt Solutions who did a face to face expenditure and the form filling and then instructed my Trustee HJS based in England who told me what i had to pay, i will post back with updates to what is happening with my situation in the hope it doesn't happen to anyone else and when the time comes i will use this site for a trustee !!!!

Hi bigj75.

I think at this stage it might be best to try to understand the timescales connected to your trust deed first. Once you know that you'll be able to plan much better.

You aren't able to apply for sequestration at the moment, so would really need to discuss your situation with your trustee first. Either they will allow a reduction in your trust deed payments, or seek to sequestrate you, or terminate the trust deed and you would be able to apply for sequestration yourself.
That is assuming that sequestration is the most appropriate solution - of course all options should be reviewed and the implications of sequestration fully explained first.

Hi again

As Mark says, I thought this Trust Deed had been set up with a very strange format, until i met with a lady this week who founf herself in almost the same situation. Fortunately, she did not sign the paperwork, but the same company were looking for payment which were just totally unmanageable.
The route you now take will be partly determined by your Trustee, and whether your Trust Deed is terminated. What ever yo do, if there is a next time ( as in Sequestration) make sure you are happy with what is expected of you right from the beginning. Good luck.

hi Bigj75
I have exacly the same circumstance with the same 2 named companies. I was visited by an agent assured the best solution for me was over 36 months but i seem to have stupidly signed into a 42 month trust deed which i cant afford and a trustee with hjc who wont listen. Is there a complaints procedure ?

Welcome to the forum mk2cosworth.

To complain about a trustee you'd use their complaints process first and then contact the professional body of which your trustee is a member if you remain unhappy.

To complain about an introducer firm you'd complain to the firm first and then to the Financial Ombudsman if you remain unhappy.
