Payment of Cheque

My husband has a car insurance policy of which I am a named driver. I was involved in an accident, which was not my fault and was given a cheque made out to me to cover treatment, which has been okayed by my Trust Deed Relationship Manager, the money went in and straight back out, backed with an invoice for payment from the business who carried out my treatment. The thing is I asked the company handling my insurance claim to pay all monies in the future to my husband as it was his policy and there was an excess on the policy that was due to be paid out of ยฃ150.00. I didn't pay for the policy so the money is not really mine. They noted this and said it shouldn't be a problem. It now turns out I may be eligible for compensation, which I wasn't expecting, I just thought with the treatment being paid for that was the end of it. I am worried I have now done something wrong in terms of my Trust Deed for getting any future monies paid to my husband?

Hi Daisy55.

If compensation is being paid to you (which I think it is really?) I'd suggest you disclose it as normal to your trustee so they can advise you of the appropriate course of action.

Thanks. It didn't really feel right. I will disclose it to my trustee and write back to the insurance company to address the potential cheque to me if there is to be compensation. Hopefully this keeps things right.

What is the compensation for, Daisy55? Did you have to take time off work due to your injury? Hopefully your trustee will take account of the circumstances and come to a fair arrangement with you in respect of any money coming your way.

The Trustee may have a claim against your claim ( pardon the pun)

Generally he would have an interest in solatium and patrimonial loss ie pain and suffering and loss of income as a result of the accident.
