I am 1 year into my TD. I had equity in my house but my husband was not allocated a share. The mortgage was in my name only . Should he have been allocated a portion of the equity ?
Hi goneunder,
In that case it would seem that your Trustee has concluded that you are the sole owner of your home and therefore your husband would not be allocated any share of the equity.
Are there any special circumstances to your situation that would lead your husband and yourself to believe that the home is in fact jointly owned?
Hi goneunder
sorry, but different laws apply here. On separation or divorce the other party may be entitled to matrimonial rights to the property. This does not apply in Trust Deeds or sequestration and if the property is in your name only, then the Trustee would seek all of the equity.
I am surprise this was not fully explained.
