What happens if I get an extra payments on overtime? I'm in a new job which my IP is aware of but my monthly wage can vary between £100 extra or lower per month, its just they type of job im in that shift allowances vary due to when I'm needed. I'm just worried that my T_deed may be extended to claw back overtime payments - could this happen? I'm in my final year of my three year TD and I have paid every payment without any problem. Also I contacted My IP to say I could pay slightly more now from the previous payments.
Only your IP can answer that for you, but normally they would take some of any overtime or bonuses, around 50%.

I don't know, I honestly cant remember as it was two years ago I've contacted my IP about the issue and explained all. No firm answer got to send in my 3 payslips & 3 bank statements which will see what I can pay back each month go up. Why do they only request the last 3 months anyway - u'd think they would check the whole year?
I also have a varied wage and discussed this at the beginning of my td. I was told not to worry as it would balance out at the end of the year when it was reviewed. At my review I was asked to send in 2 months payslips and no more was said. I have now 14 months left to pay and hope I have no problems when it ends.
Regarding overtime. If the extra money is used for essential items, ie repairs, children's essential clothes, ie, shoes, jackets, glasses. Is that allowed, or will some of the overtime need to be handed to the TD company?
Hi melissa.
Essential items should already be covered by the expenditure budget that has been set.
Therefore the trustee is likely to seek some (or all) of any extra earnings to help repay more to the creditors.
I was just wondering. My TD leaves me enough to get by on a week to week basis, but does not enable me to put anything aside for things like children's shoes, jackets, or any house hold repairs. It is only the chance of some extra overtime, which will enable me to buy these sort ofitems.
You may need to discuss your expenditure budget with your trustee melissa, but it may be tricky if you have already signalled that the allowances would be sufficient.
Your trustee may well decide to allow you to keep a proportion of any overtime you work though, which could be a good thing for you and your creditors.
I think any reasonable trustee would allow you to keep a portion of any overtime earned - otherwise there is no incentive for you to do the extra work in the first place so why would you bother?
Whereas if it is agreed to split extra money 50/50 then everybody wins - there is an incentive for you to earn the extra money and your creditors will be better off too.
Your budget should not be set so tight that there is no allowance for childrens' clothing and household repairs. If that is the case then I would suggest you should make sure your trustee is aware of this when discussing your overtime.
