I would not trust your Trustee full stop . He is very good at milking the system for his own benefit , getting paid to screw up the life's of others must be a perk of the job to him , was he not meant to solve your problems rather than add to them ??. His deadline to reply to the IPA after NINE MONTHS ! ENDS THIS COMING FRIDAY .It is a farce that he has stalled for 9 months and managed to get away with it , in my case . Still can not understand why the AIB can not finish its audit while the IPA is investigating (yeah right ) another blatant stalling tactic by him , and playing one off against the other to buy more time to charge fees for . I still have a open invite from the Justice minister to meet with him tonyd , I think we should both meet with him , and bring to his attention his failings as a trustee and the milking of the system , maybe one of the experts might wish to come along to . I will nail this guy even if it costs me my last penny. I think you can get his fees audited after your discharge , hint hint .

Something on this made me start to really worry, ie a name of a Company, I am a year in and could never have coped how you have Tony well done, shoot if it is the same Company how do i get away from them?

I'm afraid there is no way of switching to another trustee now, Pinkveggie. However, I am sure you have nothing to worry about.

Hi pinkveggie.

As Kevin has said, I am sure you will not have too many problems. The majority of trust deeds go through without any problems or fuss, especially the ones looked after by the providers recommended on this site. My particular trust deed has been running for over 8 years now and quite a few rule changes have happened since then to improve things.

Am still feeling nervous about my situation though. Have any experts got an idea about if he can change what was agreed with the creditors in my offer of composition?

I think if there has been an offer of composition and it has been agreed by the Trustee, then it is extremely unlikely that this can be altered. Unfortunately, knowing the Trustee involved, almost anything is possible!

Looks like I will just have to keep my fingers crossed then till next Wednesday. Is it normal for a meeting of the creditors to be called at the end? He included a proxy form with the letter, is this him giving the creditors the final 14 days to object?

The way it is set out does not seem clear at all!

As it's under the old system, he needs to convene a creditors meeting to see the discharge. Nothing to worry about.

Well,

14th June and a letter turns up from my trustee. States that due to no creditor attending the final meeting held on 4th June it is now deemed that his discharge is now granted. The creditors are also reminded of their obligation to discharge me of any debts owed to them.

No form five.

Is that me finished?

How long before he distributes the funds to the creditors and returns what's left to myself?

Fantastic news Tonyd , look at the AIB register it should show your date of discharge , then await form 5 , but keep the skeer on them until you have it in your hand . Time to meet up for a few jars I think . He can discharge you , but remain in office to sort out payments etc , good thing that he can no longer charge you biblical fees for doing nothing .

Have looked pinalta. No discharge date showing yet. Was just wondering if its done a different way with it being so old!

Am sure one of the experts will be along soon enough to set me straight.

Will be keeping on them till form 5 appears and more importantly to me the cash I should be getting back is in my bank and not his! Strangely the discharge does not feel that important because its taken him so long that any defaults and the actual trust deed fell off my credit rating over two years ago.

Am not letting the IPA complaint go either.

And yes I like the idea of a celebration drink Pinalta.

Hi Tony

From memory your trust deed was pre 2008 ( incredibly!) so there will be no form 5 as this was post 2008.

If the trustee held a final meeting, I assume creditors will have been paid, otherwise how can a trustee who has been discharged and is no longer the trustee deal with funds!

Hi Mark

You are correct November 2005 to be precise. Personally I hope he is still handling funds as I have not yet received the cash which I am expecting to get back. If nothing arrives Monday morning in the post I will be sending an email asking where it is!

My discharge is not yet showing on the A in B register. Am I correct in thinking this may take a few days to update?

I think it could take a few days tonyd, though most of the threads I've read on this topic here seem to illustrate that it typically happens quite quickly once the trustee has informed the AIB.
