Now I'm Worried

So today I registered with Noddle so that I could keep an eye on things and all the accounts that were in default are now satisfied except one. Santander (had a Cahoot loan with them) was showing as still in default with a balance. I emailed the person dealing with my trust deed and they've told me that no dividend was paid to them as they didn't submit a claim. WTF!!!!!

Does this mean I still owe them? They were included when I set the trust deed up. My case manager says he'll write to them and that should sort things out but now I'm worried. He says it should not change things and they should update their records but what if they don't. Has anyone got any experience of this? I should have had warning bells ringing when I received the annual letter of 'we know you aren't paying but here's what you owe us'.

Nothing left to discharge - everything's done and dusted!

Hi gillian.

It shouldn't matter to you at all.

It's up to your trustee to contact your creditors and it's up to your creditors to get a claim in on time.

Whilst there is nothing to say that Santander have to make a claim, if they choose not to then it does not entitle them to chase you for the debt. When you are discharged you are discharged from liability for ALL debts and obligations that existed at the time of the trust deed being signed.

Thanks for that. I'm breathing a heavy sigh of relief. It was looking like another reason for things to be held up.
