Hi dodgyips and welcome.

I've edited the name of the firm you mentioned due to a serious allegation contained in your post (falsifying accounts).

We're all personally responsible for what we write here so this is partly to protect you. For such a serious statement to remain on the forum we'd also need to see confirmation from an external party that the allegation was substantiated. Editing your post does not mean that I question your sincerity in writing what you did, but I request that you do not name them again.

In terms of your complaints:

The debt management company can be complained to directly. You then have access to the Financial Ombudsman if you are unhappy with the outcome.

The trust deed provider can also be complained to. If still unhappy, you have access to the Financial Ombudsman in connection to advice provided prior to the trust deed being signed (though their powers to put things right are curtailed due to the formal insolvency that exists). You may prefer to complain to the professional body of the individual Trustee (which should be listed on letters received).

I wish you well with your legal action if that is the route you prefer to take.

Hi everyone
little update from me i have an appointment with barclays today to open a bank account so fingers crossed that goes well.
I looked into coop account even went into glasgow branch but no-one was avaliable to speak to me at the time and the women said i could apply on the phone to start things off then just bring in my identity paperwork, she gave me a number as she said they no longer allow you to apply online for a cashminder has to be by phone or in branch. I tried the number the women gave me as she said i could do it at anytime there open 24/7. I rang it and was on hold for over 50 minutes on a 0845 number with constent music and a voice saying thank you for your patience you have moved forward the queue. After 50 minutes of this i hung up and was totally disgusted because 0845 numbers are not cheat and i wasn't going to put my phone bill sky high again. So that has sort of put me off going with coop bank so think as long as no hiccups today with barclays i may just stick with them for now if everything goes well.
I've also prepared letter to go out to TD company explaining i want to be discharged and my reason why thanks to help from mark, so it is a waiting game now. As i said i was due to pay them next week so i'm sure they will at some point be in contact to why they haven't recieved there money.

dodgyips i wish you and tracey luck. i'm so sorry to hear of the time she has been through i can very much relate in someways to what she has been through and i can only imagine the upset and anquish it has caused her. please let me know how she got on and tell her to keep her chinup.

Hi there Reidy 1982,
Thank you so much for the encouraging words. This case has been raised with the Insolvency Practitioners Association. A decision will be given soon. I also supplied all evidence of maladministration to the AiB. Surprisingly, the AiB saw nothing wrong with the IP's activities and dismissed the complaint. The amount of evidence against the IP is great, yet nothing was done. How sad. I have contacted the Minister with Portfolio for this government debt and the case is being looked into further. Also I am in the middle of raiseing this matter with the ombudsman. A lot of work, but hopefully worth it in the end. It would be great to get the media involved too. Do you have any contacts?

Hello dodgyips.

I'm no media expert but I suspect the AIB's rejection of your complaint would seriously weaken the attraction of your story to them.

Why not wait until the IPA provides a decision? If they come down on your side the story will be much more powerful and credible in the eyes of an external party.

Little update from me,
I finally got my barclays bank account open, i went in on friday and came out an hour later with my account number and sort code in hand. Women was so lovley really made me feel at ease about it all. I just was totally truthfull and explained the situation and she totally understood the situation and didnt see any problems. So i now have a new bank account that's ready to roll so to speak. It was actually a strange day because the same afternoon i got a call about a house swap which i didnt expect and not sure if its the right time to go ahead on with everything going on but i'm hoping this is my luck turning around. we shall see how it goes.
I also sent my letter to my Td Company so should hear back from them in future will let you know how things go.

Hi everyone,
I recieved a call on my mobile as i was at the shops at the time. The women said who she was (i didnt quite hear the name as the shop was busy). I just about made out her saying the TD company name. I automatically assumed it was in relation to my letter and wanted to be able to hear properly so i went outside.

she said she was following up about them claiming back ppi insurance on my behalf. Shocked i automatically stopped her in her tracks by saying to her so your not calling me about the letter i sent to your company about being discharged. The women went quiet on the other end and said no, she didnt have any knowledge of such a letter on there systems.( strange considering I sent it while ago so surley they have received it by now there office is in same city so wouldn't take to long to get there) I explained i had sent a letter to the company in regards to being discharged and my reasons. I also told her i was not aware of any ppi on any of the loans and wasn't aware of me giving them permisson to persue any ppi on my behalf, There was no ppi with any companies i had debts with i know this because before i went into a trust deed i checked it I had none apart from with one company from 2007 which is no longer in business and i was told because the company was no longer in business it would be harder to claim back. i Also said to the women it was little strange to give me a callback about this when this is the first i had heard of any of it . The women just went very silent then she just said she would note what i had said on there system and i was to await the outcome of the trustee decision on my letter and said thanks .

My question is does this mean they are going to try and see if they can claim back any missold ppi insurance to put towards my trust deed?? As i thought i would have had to sign somthing to say they are acting on my behalf to do this or fill in forms?? PPI has never came up in any conversations I ever had with the TD Company infact I didn't even know they could claim it until today as i assume they would class it as a payout into my trust deed??? so I think it is a little strange for this to come to light now of all times and Considering what has happened and the fact i am trying to get out of this to go to petition for sequestration i would hate for this sort of thing to cause problems.

Also my other question is i have been offered a house swap to a little bungalow through my housing association swapper site (I have been on there for 2 years waiting for a house). which would be much better for me as it means no stairs to walk up and down when trying to go to the back garden or bins to put rubbish out (I have shared back garden with very steep stairs to go down to enter it) My question is will me making a home swap cause any future problems in regards to what is happening with my trust deed whilst i await for a response to my discharge or cause any problems if i ever get discharged and petition for sequestration. As the house i have been offered has two bedrooms. I am upto date with my rent so there is no problems there. I am just wondering if anyone has any other possible issues that may come to light if I go ahead on this especially with the home being slightly bigger. I remember i was told when i entered my trust deed i would have to inform them as there maybe issues of gas and electricty being higher in a bigger home. I'm just wondering if it will be the same issue if i do petition if i am discharged.

Glad you got an acount with Barclays. I think they are absolutely fab!
Regarding your PPI, you normally have to signa
a form to say it was mis-sold, your Trustee can say that for you, as he was not there.

As for your opportunity to move, I would go with it, it may be years till you get another offer, and your health is more important. All you have to do is inform your Trustee of your new address. The same would apply in Sequestration- keep your Trustee informed. Sounds good to me [:)]

thank you for the advice shona much appreciated.
I thought it was strange with the call considering i've never signed anything or even spoke to them in regards to any missold ppi and just wanted to be sure they could not go ahead without my consent and hold up my discharge with an open ppi case if they give me the decision to do so.

Also thank you for the advice on the home swap offer i really hoped that would be the response and just wanted to double check before i went into it incase of any future problems arising so i could be aware.

Reidy1982, if your local credit union offers a current account. They will be able to open a basic ATM account for anyone who is bankrupt. This will be reviewed on a three monthly basis , with a view to building trust and changing to a debit card. You can also access the credit union per-paid cards, these also allow you to operate DD's , SO's have salaries or benefits paid into your card. You can also use it online , in shops etc.
