Hi

I have a trust deed in place since dec 2014 I have not paid anything towards this yet as i have not heard from Wilson Andrews since ? My payments were due to start beginning of April but nothing has ever been taking .

I also had a look at my credit report all my creditors are still reporting as missed payments should they not all say default ??

Also when I took out the trust deed I had 3 kids we have our 4th due in August which is going to change my circumstances big style !

I have no clue what to do I fell with signing up to this TD all I have done at the moment is put a court judgement ony file and nothing else has change with my debts .

Hi Jml1983 and welcome.

I think you need to contact your trustee ASAP for a status update and to make sure you're meeting the obligations you agreed to.

Should they not be contacting me though ?? Why have they not done this ?? It's a joke . Should my debts be showing default on my report as my trust deed is showing active since dec 2014

I can guarantee you something, your relationship manager won't be the same person, I think I've had six or seven with WA in my 3 years and not once have they contacted me to advise the change, I found out each time when I contacted them only to be advised x had left the company.

Every end has a start !!

Hi JML

While you may think that it is their responsibility to contact you, you will still be responsible for the Trust Deed you signed - sooner or later. So any delay in starting would be a delay in ending.

if it were me, I would contact them and try to take any control you may have to ensure it is conducted as agreed.

You may not like how they are managing it, however, I believe you have to keep with them so best making the most of it - even if that means you making the calls to ensure the payments are getting to them.

If I had a feeling of uncertainty, I would keep a note of all calls and conversations(dates, times and names and content/agreement) and possibly a copy of any statement you have where the payment is going out of your account. Keep it in a folder and then you can always refer to it in the future if there are any questions.

That's my thoughts anyway. Good luck.

Why do we pay TD companies a fee? Yes a large part of it is to administer the TD but surely an email or a letter to say that your Trustee or Relationship Manager has changed is not too much to ask

I too have found myself in this situation with Wilson Andrews. 3 different Trustees and 3 different Relationship Managers and no notification to advise me of this on any of the changes.

It would seem that profits and fees first customer service second - if you're lucky that is.

This is Jml1983's proposal to his/her creditors (brokered by the trustee).

Everyone involved has a responsibility to make it work.

Hi Jml1983,

Try to be proactive and take control of the situation like Firewalker has suggested. I'm not sure why someone hasn't been in contact with you to start payments but a quick call to them should clarify matters for you and get things back on track.

Do you think with the arrival of your 4th child in August you will be able to maintain the payment which was agreed you would pay towards your Trust Deed at the outset? If you don't think you will be in a position to pay the payment your best to highlight this to your Trustee at the moment.

Once you know what the position is with your Trust Deed let us know and we can provide you with further advice if required.

Hi Spencer.

We ask all members to avoid posting links and contact information in the forum. I'm sure you'll have noticed the representatives from other firms following this same protocol. As such a couple of your posts have been edited.
