This is a problem in some cases, especially if the debt was passed to a debt collector. Because the Trust Deed is protcted, there is no chance of court action.

Speak with your IP and ask them to contact the Insolvency Exchange who act for RBS in making the decision. Hopefully they will be able to resolve it.

my trust deed was protected in sept 2008. last week I got another letter from the halifax about a credit card balance . I have contacted my trustee at least 5 times about the halifax. no joy.

Unfortunately it can happen sometimes that for some reason a creditor may continue to send letters etc demanding payments. I think it is probably just some kind of glitch in their system sometimes - and from experience it is surprising how difficult it can be to get the problem sorted. Occasionally you get an assurance from the bank etc that they will not send any more letters but then they seem to carry on sending them regardless. Do keep letting your trustee know if you are getting hassle and if they are worth their salt them they should get it stopped eventually.

As Mark says though - there is no need to worry about court action, despite whatever the letters might say.

I had the same problem early on in my P.T.D but was advised by my Trustee that phone calls from creditors who are part of the Protected Trust Deed are actually classed as Harassment and legal proceedings can be brought against them, i ended up really losing my rag with a guy from Mercers Collection Agency one night, he apologised and miraculously found my paperwork within 3 minutes(honest to god- "oh yeah Mr Thompson here it is" - you know what i mean) I never got another call or Letter. Just tell them that you,ve had enough and will be contacting your Trustee to sort them out. Good Luck
