Not had an income expenditure review since I signed my trust deed 5 years ago last payment to be made on 1/11/13 is it/ was it ip to me to send these details or should my trustee have done this. I'm now worried I will have to keep making payment for longer.

I'm not an expert but if you contacted them with the changes in your circumstances then i dont see how they could make you pay more. That would have been up to your IP to then re-calculate at that time.

Hi bsmith

It is not a legal requirement to request reviews, but certainly good practice and in the guidance.

There is an onus on the individual to provide details of any material change in circumstances ( good or bad) but the trustee should also request updates as part of the process.

Hi bsmith1986,

We'll done in coming this far in a 5 year Trust Deed.

Most insolvency practitioners use a system called IPS which is software program to administer and progress all of their cases. Within this system there is a diary which should prompt the staff of the Trustee to send out a current status report. We automatically send one out every six months to our clients.

As Mark said it's not a legal requirement but good practice to do.

I think it's very unusual not to have had any review forms out in 5 years but I don't think it's anything that will cause you a problem.

How have you found the whole Trust Deed process?

Its worked fine so far but reading a few stories about getting dischared has me feeling like this is going to go ob for a good few months after the final payment is made. Hopefully It wont be the case. Wish I had found this forum sooner.

As the others have said, as long as you contacted your trustee to let them know about any major changes then it is up to them to advise you at the time about any changes to your contribution payments. They cannot come back to you at the end of your trust deed and argue that you should have been paying more.

It might be worth calling your trustee once you have made your last payment to confirm that they are arranging for your discharge as soon as possible.

I get my reviews annually and the last 2 have been mid-October but I've heard nothing yet. I informed my trustee about a slight pay increase in April and they did a full review then. Would that IPS system that David mentioned take that into account and mean that I probably won't get another (and final) review until next April? My 42 month TD is due to finish next June.

Glad that's over with....
