Sorry for just getting back to you all, been down with this sickness bug the last couple of days!

Thnaks Pamjo, talked it all through with my husband and think we are basically agreed that we will hold out for the council unless something else comes up in the meanwhile. We would have to try and come up with £713 plus £475 plus £175 for checks and over Christmas it's just not going to happen, even with not paying the mortgage. The insecurity of this house just totally put us off private rental.

Thanks for clarifying that for me Kevin, at least I know if the council dont come up with anything until Sept then the shortfall would still be included. We are still awaiting news from the trustee about it all after we went the letter a couple fo weeks ago.

Thank you Paul, Nram have said they wont accept less than £500 a month which is the full interest only payment plus £18 a month towards arrears so if we want to stay put until the council come up with something I guess we will need to struggle on and try to find it each month. They say that we should forget about paying the trust deed as a mortgage comes first in front of everything but they would say that wouldn't they.

Hi gillianr2.

I think any debt adviser would tell you that making payments on your mortgage is more important than repaying unsecured debts (as NRAM have done).

Paying a trust deed where it's viable is important, but a roof over your heads is much more important.

Gillian.......

Your Rent/Mortgage is your first priority, any debt advisor will tell you this.... The roof over your head comes first...

Thanks, it's a shame the trustee doesn't see it that way though. They have told us they muist be paid first and that the original income and expenditure allows for the mortgage payment. I understand that have to realise the amount they otlined at the beginning, it's just tough being pulled in all directions though.

Dont be pulled in all directions about your mortgage gillianr2.

It's vital that you pay it, even if that leaves you unable to pay the trust deed.

Gillian,

I can only echo what TDA say's through my work I have attended many training sessions with CAB and other money advisor's, it is always agreed your 1st priority must always to pay your Rent/Mortgage before any other bills.......

Thanks guys, will try the trustee again to see if they can be more leniant but to be honest I doubt it, they still haven't even got back to us on the voluntary repossesion yet and that was 2wks ago we asked.

Thanks plasticdaft - they have always been this way when asking anything about the trust deed, it always takes them an age even when prompting unfortunately.

Sorry I have not been on the forum for the last week, but have been working all over the place! I can understand why you have decided not to take this rental any further, but you stil need a roof over your head. I think your Trustee is not being realistic if they expect you to pay them before the roof over yout head. You are in a difficult position as you want NRAM to repossess the house so you can walk away, but you need to have a roof over your head meantime. Nothing will happen before January, so try not to worry, and you can see the money adviser then.
As Kevin said, the shortfall will go in your Trust Deed anyway.

Thanks Shona, I appreciate you replying to me even though you are so busy. We have agreed with Nram to pay £500 on 30th Dec, rightly or wrongly we got scared. Hopefully the money advisor will help us in Jan to sort something out until we can hand back the keys which could be a way off with the council, hopefull not too much past the summer though.
