I've written previously on here about having problems getting in touch with my trustee - Knightsbridge insolvency, previously Kelsom associates.
They are a nightmare to contact, they don't reply to emails, and any phones calls get diverted to their Manchester office who don't seem to know anything about scottish trust deeds. They claim that they will forward my message on to the right people, I'm not confident that this is happening though. They are changing name which is their excuse for me not being able to contact them.
I've written into them also and had no response. Sometimes I wonder if I've fallen for a scam and the money that I pay in every month is going to a fraudster.
I'm not confident to carry on paying into them, is there anyway that I can validate them?
What would happen if I cancel the the SO? I've heard that they can arrest your wages, how long after missing your first payment can this process take, does anyone know?
Am I the moly one having Problems with this company?

Knightsbridge are a well-known company and last time I checked they were setting up more trust deeds than any other - so they are certainly not scamming you. Sounds more like a customer service issue than anything else.
I would be very wary about missing your payment. The consequences could be a lot worse for you than the (hopefully) temporary communication issues you are experiencing.

I'm with Knightsbridge and I've never had any problems with contacting them via phone. Do you have the correct no? If not, check out their website. They definitely do know about STD's as myself and many more have one with them.

No, I went through Trust Deed Scotland and I was assigned to Knightsbridge. I just call the number that is on Knightsbridge website, it's an 0845 no.

I tried that 0845 number and they couldn't find me. Guessing because I'm it showing as protected on the insolvency register.
I can see the initial notice to creditors online which expired on 28th march 2014.
I'm really concerned that I have been paying my standing order every month for the last 5 months when my TD might not even become proctected. I've paid in ยฃ790 so far.
Does anyone know if I can claim that back eventually if it doesn't go proctected.
I've written a strongly worked letter to my trustee which I have sent receded delivery this time.
Hopefully they'll get back to me!!

Ha! The dangers of predictive text!
If the trust deed fails to be protected, the trustee will not refund any payments as the trust deed is still legally binding.
It would be very unusual for it not to be accepted as we work with a set criteria list and as long as we stick to it, there should be no issues. It's a pity your trustee can't seem to update you to at least put your mind at ease.

Yeah I don't know what's going on. I'm in the dark, hopefully I'll get a reply from my letter to them.
I just feel like it has failed as it hasn't became protected after 5 months.
In your experience has it ever taken that long?
Will I have to make another 48 payments from the day it becomes protected? I've made 5 payments now, surely I'll have 43 left now either way?
Will you be my trustee Mark? at least you reply to me lol.

If your trust deed was signed after the changes in regulations to a 4 year trust deed on 28 November 2014 and it's not been sent away for registration as protected then the Trustee has missed the boat I'm afraid.
In terms of the new regulations, the Trust Deed needs to be sent within 4 weeks of expiry of the 5 week period otherwise it cannot be registered as protected and the Tustee will require to start the whole process again.

That's sounds like I'm going to lose the 5 payments I've paid in already?
Surely that's not my fault and they shouldn't be allowed to keep the money for themselves?
If they have to start the whole process again does that mean that I am free to leave them and move to onto a new trustee or deal with my creditors on my own again?
I've lost confidence in them so that wouldn't be the worst thing the world!

I know you've tried previously, however you will need to speak with the trustee to find out exactly what the position is. Failing this, speak to the AIB and ask them to investigate.

What I'm hoping has happened is with the changeover from Kelsom to Knightsbridge there may be a period whereby it's taking Knightsbridge some time to sort the new cases they have taken on and get them progressed. At the end of last year a similar thing happened with two other firms and for a couple of months there was some disruption to the communication but it was resolved.
I know this is far from ideal and the uncertainty about your Trust Deed must be very worrying for you. In a situation like this I would even have suggested dropping by their offices to speak with someone face to face but they are based in England. I have clients who drop into the office for a quick chat about their case all the time as I'm based on Glasgow City Centre.
Try to keep on top of them, become a bit of a nuisance until you receive a full update on your case. As Mark suggested you could even contact the AIB and ask them to look into it.
Your Trustee can re-advertise your Trust Deed and another 5 week period would commence. If creditors didn't object to the first proposal then it's extremely unlikely that they would to a second proposal. If this does happen and your Trust Deed becomes protected then the payments you will have made will count towards your overall total of 48.
If you are not happy with the advice or answers that you receive from the AIB or Knightsbridge then as a last resort you can consider suspending your payments to your Trust Deed until you receive a full update. There is a risk doing this but it might be the only way to get answers.
