dealing with the ombudsman at the moment,invocas denying any wrongdoing and sent the ombudsman off to deal with easytoclear debt solutions even though they don't exist anymore so I had to set the ombudsman back on the right track and they are now contacting invocas again but I think you may be right as I don't feel the ombudsman know what they are doing and this isn't going to go well,if this does go badly what else can I do.ger

I'm not sure what can really be added to the advice given on this thread already, ger. Have you tried the Trustee's professional body?

got call today from ombudsman who tried to contact easytocleardebt solutions after saying that invocas has done no wrong and that easytocleardebt solutions were to blame for mis information unfortunately they are going into administration and never even bothered to get back to the ombudsman so hes not upholding our complaint so that's that then.pretty poor I think so possibility of losing my house,said this to ombudsman and he says that they will probably ask me to remortgage but whos going to do this as I am still in a trust deed,seems like a catch 22 situation to me.depressed.thanks for all your help guys.bye

Did you decide not to take your complaint to your Trustee's professional body in the end then?

I have always argued I was misinformed at the start by the trust deed company . I was informed I had equity to release but that would be no problem as I would be able to " remortgage without a problem " . Both my husband and I questioned this as we sat in their office , totally vulnerable , trying to keep our home . Not a problem they repeated !!!!
Not the case . I am now over 6 years on having made contribution monthly for 5 years and battling to save my home.
Now have an excellent credit history but can't borrow a penny as some of the companies didn't put a default on me til a year after the trust deed was in place ! Catch 22 all round.
Totally misinformed at the start . Debt free after 3 years !!!
Since July 2008 I have been crippled with fear and embarrassment at the thought of losing my home !

sorry to hear how you've been treated everything you have said sounds so familiar we have just been told that the ombudsman is not upholding our complaint and we now don't know what happens next or what we do next I just wish someone would take over the reins and sort this out amicably help

Unfortunately I think it will have to be you that continues to fight this if you consider that you have been treated unfairly.

I think the option of approaching your trustee's professional body remains open to you?

We paid the ยฃ500 to protect our TD so at the end they could not look at the equity in the house even though at the start of the TD ther was no equity.

Sadly it doesn't seem as though this was an option here seeing as there appeared to be equity when the trust deed was signed.

I am going to contact invocas to see what happens next do you think I should ask for an independent valuation of my house so we can find a starting point

Hi dlareg32.

Did your trustee already organise a valuation? Presumably they will have used an independent professional if they have. If that has happened you may need to source your own independent professional valuation to challenge the figures that are being used.

I feel so sorry for you all of you having to go through this,there seems no help for anyone who is mislead in this trust deed industry to me, even the ombudsman cant help, so many companies desperate to get your signature then sell you off when your not worth anymore to them, shocking and shamefull way to operate and treat people, my only one bright light is that i know one day this business will be exposed and people who have been victims of this miss selling culture will see justice.
