Hi again. I wonder if you could give me some advice: I entered by Trust Deed in February 2009. At that time I received a letter from Eversheds advising me that had taken over my account from Barclays but that they knew about my Trust Deed and would liase accordingly my my IP direct and that I wouldnt hear from them again. In February 2010 I got a statement of accounts from Max Recovery, working on behalf of Evershed's providing my an annual update of my account. Can I request that these statements be sent to my IP or do I have to put with them?
My other question is this; how many times a year does an update go out to my Creditors? I have been extremely unsucessful in getting answers from my IP. I contact my case worker via email and get a "read report" but I never seem to get a response! Any help here is greatly appreciated.

I think this is now a requirement by creditors to advise you. You could always ask that the info be sent to the Trustee, however if they have advised that they are aware of the Trust Deed, then this is unlikely. Its nothing to worry about though.
There is a requirement to report to creditors on an annual basis. I'm amazed (or perhaps not) that you have not been advised of this.

Hi Newbie65, apparently if you have fallen behind with your contractual payments, the creditors are required to send you an arrears notice, every six months, in order to comply with the Consumer Credit Act.
Mark is correct that a report should go to your creditors on an annual basis, you should also get a copy of this report.

Thank you both for your response. It is much appreciated and helpful. The letters from Max Recovery with the annual statement is the only statement/correspondance I receive. I have had nothing like that from any of my other creditors since I entered my PTD. I wont worry too much about it though.
