Don't worry, despite having a Latin Higher ( honestly ) I only came across this yesterday as it was a question on one of the firms IVA's!
I did hear it once on Treasure Hunters on the TV when there was no one to inherit an estate, but didn't think it applied to Insolvency.

Marlin have still not updated the details reported to the various credit reference agencies. It's 28 days on Friday since I complained to them. The letters I've sent to lenders have always included the threat of advising 'The Information Commissioner' but I've never yet had to do it. Can anybody advise if it's worthwhile doing anything in this regard? I only ask as I'm 99.9% certain that Marlin are going to take forever over this.

You must be really frustrated.
As well as the ICO, you may wish to consider the route of contacting the Credit Reference Agencies and provide them details and copies of your discharge and your communications to Marlin. Noddle and Experian both offered to help if I could not get action from the credit companies.

Thats the first time I've heard of a credit agency willing to assist if they creditor does not update their files. Good on them.

They're in a tricky position Mark.
They too have a data protection duty to keep the information they make available accurate.
I think this may be why they're offering to intervene more between an individual and a financial institution.

Good point, but it goes to show that credit scoring is not an exact science and like everything else the information at one end depends on what in input at the other end.

Here is an extract of the email I received from Noddle:
When you're discharged from a Trust Deed, the insolvency practitioner should contact all the lenders involved to advise them you've completed the Trust Deed and ask them to mark the accounts as ÔÇÿsatisfied' and closed. The lenders should then do this and update the credit reference agencies.
In essence, it's the lender's responsibility to ensure the data they're sharing with credit reference agencies is accurate ÔÇô if this doesn't happen it falls to you to ask them to correct the information, as you've done. As you've tried asking them to amend the account information as they haven't responded, we can now take the issue up with them on your behalf.
In order for us to do this, I'll need to ask you to please raise disputes against each incorrect account by clicking the corresponding ÔÇÿLet us know' buttons on the website. When you do this you should be given the opportunity to add some notes in a free-text box ÔÇô please briefly explain here that I've asked you to dispute the accounts as you've sent your discharge paperwork to the lenders but they haven't responded (if you don't do this your disputes may be processed incorrectly).
Once we've received your disputes our Disputes Team can then contact the lenders on your behalf to ask for the accounts to be marked as closed from your Trust Deed discharge date. They'll contact you with updates within 28 days of the disputes being raised.

EXPERIAN was similar but I cannot find the e-mail right now :-(.
That's interesting, although I'm not sure any firms contact creditors and ask for the files to be marked as satisfied once completed.
The normal process is a circular to creditors advising that the trustee is seeking their discharge and enclosing a final dividend payment.
Seeing as it's Friday, I might revisit our letters and add that wee bit in. Belts & braces.

Thanks for the information. I'm going to give Marlin a call now and see what they say.
The main frustration has been paying the monthly fees to both Experian and Equifax from September when I was discharged whilst regularly checking to see if the updates had been made. I've now paid nearly £200 for this and thought it was finished with everyone finally reporting correct information only for Marlin to throw a spanner in the works!
Sorry to deviate from the thread! Latin Higher Mark? I am impressed as I wish I'd kept up with my Latin at least for a bit longer - it would have been so useful in my job now!!! Meanwhile I wont deviate any longer.

I must say, the only 2 uses I've found are for translating tombstones and telling my wife what year a TV programme was made by the letters at the end.
I only started doing it as I thought the course book 'XXX Roman Stories' looked ahem! intriguing. Turned out it was a book with 30 Roman stories!!
