Aaaargh...a year after completing my Trust Deed and after spending months chasing up, and clearing up, all the entries on my credit file up pops a new one "Marlin Financial Services". Surely my ex creditors are not still selling on a settled debt? Has anyone else had this happen to them,I don't want to open any dialogue with them until I know what I am dealing with as the credit file entry is currently showing up to date (waiting to be updated).

Hi jockdock.

I understand that Marlin are a debt purchaser.

Using either your Form 5 or the public records hopefully you'll get them to quickly update their systems and your credit file.

I'm aware of Marlin purchasing debts before the trust deed is discharged, but can't see why or how they could do this if the trust deed was finalised.

Has the trustee been discharged?

Thanks for the replies, Trustee Discharge was just over a year ago and all payments have been made. there is only a partial account number on my credit file which I don't recognise so I have no idea where this "debt" originates from. I don't want to contact them and give any details in case I open the floodgates to letters and 'phone calls so it looks like I will need to wait to the next update on my credit file and try to find out what their intention is. I have Googled them and they don't sound very pleasant to deal with.

Hey there. Same thing just happened to me! I'd had correspondence a while back (after discharge) to say Marlin had acquired the Northern Rock debt so I sent them the discharge letter etc and had a response from them to say basically 'Oh sorry we'll update our records'. Then today I had a credit alert email (fortunately I hadn't yet cancelled Equifax) and lo and behold Marlin show as a default with completely incorrect details. I called them and they have assured me they will sort it but I'm furious after working so hard to clear up my file that they could ruin it again so easily!!

That must be frustrating Beloved_Aunt. I suppose it may not have been within their control if they weren't given up to date information at the time of the debt purchase.

Hopefully they'll be good to their word and quickly correct the entry that's been put on there. That's certainly within their control.

Make a complaint as NR should not be selling on a debt that no longer exists.

Apologies for hijacking the thread but wanted to ask a quick question. In my letters to creditors previously I have been advising that the default date should show on my file as the date when the trust deed became protected. Most creditors have gone with this and updated my file accordingly. Tesco, however, maintain that the date should be the date of the creditors meeting which was some months later. I'd like to reply to them and relate to some specific guidance but wondered where I could find this?

Hi Beloved_Aunt.

They're wrong!

The Information Commissioner told us that any default notices should be dated around the time that your trust deed began.

If Tesco won't agree to that then hand the complaint over to the ICO.

To be honest it sounds like they're talking about an IVA rather than a protected trust deed anyway.

I think there will alway a be anomalies, especially when they try to apply IVA rules to trust deed.

We've hat arguments about the dates claims should be made up to with some creditors stating it's the date of protection, when it should be the date of signing the trust deed. One this week was applying Bona Vacantia ( money going to the Crown ) to a company who had submitted a claim, but was then dissolved, whereas he we consign the payment to the AIB.

Oh! the whacky world of insolvency!

I'm just guessing, but I think there are probably now much more than a million words in this forum written by our members over the years. It's a vast library of words and phrases.
