I have lost my job through capability illness. I have applied for esa. I get child tax credit, child benefit and housing benefit. I have been awarded dla and have had it backdated. I was wondering how this will affected me. I thought contributions was on earned income. I was told I would have to pay contribution cause I was not on basic benefits. I am so stressed out and it is making my health condition worse. I just need to know what is going to happen.
Thanks.
Hello emma99 and welcome.
I'm assuming that you're already in a protected trust deed? If so I'd imagine any assessment of a revised payment will be based upon affordability (income minus expenditure).
Have you been through these details with your trust deed provider?
Have they told you what the new payment will be?
No I have not been told my new payments. I am still waiting on hearing what my esa will be. I am due payment in leiu and holiday pay from my work. My wages were decreased in august but I still had to pay same rent and council tax. So I had to use my backdated money. I do not have alot left I am really worried about what they will do. I did not realise that dla was included.
Thanks.
I have seen on here expert saying that if you are benefit only income you do not pay contributions. Not sure if this is right.
thanks.
Hi emma99
Legislation states that trustees cannot seek a contribution from benefit payments in sequestration in terms of Taxes Management Act ( from memory), but not trust deeds. In trust deeds, trustees are advised they should not seek contribution payments from benefit income, however this is not legally binding.
Your trustee will probably do a revised income and expenditure and if your income has dropped, then it may be that there is no surplus to seek a contribution.

So what happens to my backdated money from dla. I have spent alot of it so what will happen to me. I am worried they could freeze my bank account.
Thanks
Hi emma99.
They'll need to run an affordability calculation incorporating that backdated amount and be guided by their findings. I think you'll need to wait until that's done to find out if any of this sum is due.
Thanks very much for your advice. This was affecting the health condition I have and making it worse. I will just need to wait and see what happens. I am not recieving esa yet but my claim is in. So don't know how much I will get. I was just so worried about this backdated money.
Thank you.
I meant to ask is there anyway I can give consent to someone to deal with my trusted deed as I don't think I can so this myself.
Thank you
There is nothing to stop you giving consent to a third party to deal with matters on your behalf, though your trustee is entitled to insist to speak to you directly, emma99.
