Myself and my partner received seperate letters from RBS saying that our joint account would be closed and we had to ensure it is in credit within 30 days (it is 600 overdrawn). He will be liable as I signed a TD which is not yet protected (1 week to go). He doesn't have this amound of money and certainly isn't happy that he's left with it to pay! Do you know of any arrangement that we could come to without his credit rating being affected to allow for this to be paid back? He won't go on the phone to sort it out so I guess I'll need to. Thanks

Hi prenticebaby.

If the funds to repay the balance do not exist I would think it very likely that RBS will be prepared to accept a payment plan to clear it at an affordable rate. As you say, this will be a case of coming to an arrangement with them.

I'm afraid I don't know whether this will affect his credit rating in any way. You may wish to ask RBS whether they would make any reports to the credit reference agencies if an agreement were made and stuck to.

Hopefully both of your incomes are being paid to another bank prenticebaby? There is a risk they will be swallowed up by RBS if not.

Thanks for the replies. I had to change banks as RBS is one of my creditors so I have no monies being paid into any of the accounts although they are still open at present. On the otherhand, my partner still banks with RBS and has his own account where his salary is paid into and another account which we use for our son for birthday, Christmas etc. I will call them today to ask if he can come to some arrangement. We don't have a spare 600 in any of the accounts so hoping they can't take what's not available from the 2 accounts my partner has remaining!

Hi prenticebaby.

I think that your partner needs to move his sources of income to an account at an unconnected bank as soon as possible.

Hidden in the small-print of the joint account will be clauses enabling the bank to take money from one account to repay another if he becomes behind on payments.

If the overdraft on the joint account has been called-in, the other accounts may become targets when he next receives a payment. Even if there is less than ยฃ600 there, they may take what is there once the thirty days have expired.

OMG this is really messy, I wanted to keep him out of my debt problems as he is able to manage his own, why should he be penalized for my wrongdoing, anyway that's just the way it is I suppose. I will need to try and find the 600 from somewhere, do you think I could take a payment holiday from NRAM who are another of my creditors? Would I need to let my trustee know, is it better to wait until next week once I find out if my TD has become protected? I am too proud to ask any family members for this sum.

Are NRAM your mortgage company prenticebaby?

If they are they miss wish to help but I suppose it depends upon the terms of your mortgage.

Yes they are, I've had a payment holiday in the past a couple of years ago. Do I need to let my trustee know my intentions?

That's a tricky one prenticebaby.

If your expenditure is reduced they may consider that your trust deed payment should be increased.

No harm in asking I suppose and I hope they help you.
