Well guys just to let you know I am still alive and fighting back .
Come the 10th of next month , it will be 8 months since I sent my complaint to the IPA . Guess what !! , still no further forward . Been 5 weeks since I heard anything from them, this whole investigation is a farce and I am left in limbo with him trying to rack up fees by doing nothing . My offer of composition was accepted over 2 years ago by my creditors , was told by my Trustee you can not close a deed in the way , since found out he has made a similar offer for another person , not enough that I have been lied to , but he gets away with it as no one has enough spine or guts to pull him up about it despite having written proof I have been lied to .
Do not get my started about the AIB in Scotland , there has to be a radical overhaul of the complaints procedure and time scales for things to be sorted set in stone , and punishment of bad practice should result in severe action against those concerned .

Heard back from the AIB , my Trustee has until the 6th of this month to provide missing paper work which has not been forthcoming . If its returned then , hopefully a determination will be issued regarding his fee's .
Either way , I will accept the determination. obviously hoping they will rule in my favour just hope he does not throw his rattle out the pram if things go my way , a delay my discharge further .[:p]
Got a letter back from the IPA this morning , guess being a pain in the butt for them paid off .
My Trustee has not responded to the IPA and continues to ask for more time , with various excuses including the audit by the AIB .
Due to this , he has been referred to the investigation Committee and given a formal deadline to provide a response .
He now has 28 days to reply with a full and detailed response , otherwise further action will be taken .
Given he has done the same thing regarding the audit of his accounts by the AIB , and not replied to the financial ombudsman either , then I feel vindicated in my complaints against him , still not at the finishing post , but the same thing happening to 3 different organisations must point to something .[:0]

I to have just received a letter from the IPA saying that my matter has now been opened as a complaint investigation and that a regulation officer will be in touch with me.

Guess what ?? , spoke to the lady who is auditing my Trustee's accounts today . My Trustee advises that ALL my case notes/ files have gone missing and blames the legal post system . Very strange as he has been looking for them since September of last year . Now Watergate does not bother me , does your conscience bother you , tell me true , sweet home Alabama ............. Audemus Jura Nostra Defendere , tonyd bug the IPA daily by phone or e mail otherwise you will be making ropes from sand .
Well my case files have been found , they never even left the office .
Some thoughtful person decided to archive them thinking my trust deed was discharged due to 2006 being on the box , if only .
Down side is the AIB can not audit the accounts until the IPA has ruled on my case , given due his stalling tactics he has got until the end of the month to give a full written reply to my complaints I can see this going on for months , even though my case was opened in September of last year . He must be the worlds best dairy farmer due to the amount of milking of fees and the system over the years , but I will see this out to the end. I smell blood and it aint mine .
If , the AIB reduces his fee's who gets the surplus if you have a offer of composition in place .
Any available funds are usually disbursed to creditors until their debts are repaid in full in a trust deed. Your situation is a little unusual, pinalta, but I would be surprised if creditors didn't expect whatever is available to be paid to them.
If an offer of composition has been proposed and agreed, then that is that offer which should be paid regardless of any change in fees.
It's an incredible period of time for effectively nothing to have happened with either the IPA or AIB.

I agree with you Mark , just goes to show how he can manipulate the system to stop one regulatory body doing anything whilst the other is meant to be doing something , the AIB can not progress further until the IPA has given a ruling . Taken that he has hindered and stalled for months , he manages to squeeze to the end of this month to give a reply to the IPA , even though my complaint goes back to September . Why can the AIB do nothing without waiting for the IPA ?? surely time for much needed reform .
Been bugging me for the last few days .......... why can't the AIB do anything while the IPA is taking up my case ?? , yet another waste of time , while both sit on their hands waiting for my trustee to get his finger out .
