I was in trust deed from 2006, supposed to be ending 2009, ended 2011, over running 15 months, through not fault of my own, 36 payments on time, these people who were handing my case were extremly bad executing there job, i had 17k of debt which after my house was sold my funds in the trust deed were approx 30k, on initial sign up with invocas it clearly stated that there fees would be 4k, my debtors were fully payed off with interest, and invocas manged to account for the rest by increasing there fees, in the end i had nothing left in the trust deed to be returned back to me, i contacted the AIB, who conducted an audit on my case, which turned out that the fees due to invocas would be 8k approx, but because the case over ran by 15months i was charged accordingly, i also contacted the financial ombudsman but got now where with them, if some one could advise if i can take this any further or would be willing to help me i would be grate full, other wise people, PLEASE DO NOT USE INVOCAS. And think very care fully before signing to a trust deed.

Hi alex2258.
I'm really sorry to hear that things did not work out as you would have hoped.
From the perspective of the site I think we need to be careful here. It would appear that the AIB has concluded that the fees charged were reasonable?
Did the Financial Ombudsman tell you that this issue falls outside of their area of coverage?
You may have the ability to take legal action if you feel strongly about this. However, such a move is likely to be expensive and the fact that the AIB sided with your trustee may be quite unhelpful to your case.
Invocas provided all time sheets that were allocated to my case to the AIB, I requested that copies be sent to me, as i had previously spoken to someone, and they did not see that my case was difficult.
I requested that the AIB send a copy of the information that invocas provided them, to me, which they declined, all i needed was for some one to explain to me how my case warrantied the substancial increse on fees, from 4k to 13k
Financial ombudsman was not interested because the AIB were involved.
I note that you say that the AIB sided withthe trustee, but in reality they were not the one that had to deal with them at the end when i was trying to get discharged, cosed shop i may think!!

Gosh that is worrying, we were with invocas. my last payment is due next week. We continued to receive letters from some of our creditors, even though we were forwarding them onto invocas.I sure hope we dont end in your situation.[?]
Watch them very closely, at the end they said that i had only made 35 payments, logged into my account with RBS digital and printed off 3 years statements and send them off to Invocas, took them 2months to reply only after my prompting several times by phoning, eventually after approx 15 months i recieved my discharge, they admittedthat they were running late with final discharges, but charged me for THERE OVERRUN, APPROX ยฃ500 OF FEES, They quickly realised there mistake and withdrew the charge , but managed to swallow it up elsewhere, to cut a VERY long story short, i still ended up with nothing, as previously stated on this forum, i had 17k of dept which i payed 30k into the deed,
on hind site i would not have entered into a trust deed, and something should be done about capping these peoples fees, Who is monitoring them that they are carrying out THERE duties to justify the ammount of money they charge, also you will find that they are the 1st in line to recieve there money before anyone else. I'm not a happy Bunny, and you will probably find that no one is willing to help you, if you try to take them to a small claims court it will cost you, I just lost the will to live when dealing with them, and probably there are more companies out there who are in the same boat charging huge feesand cannot or will not justify them.
TAKE CARE AND HOPE ALL GOES WELL.

Hi alex2258.
I think everyone reading this will agree that the fees you were charged seem very substantial.
I think also that it's entirely reasonable that you have details of how the fees came to that level.
The AIB is however a government body and quite independent of insolvency practitioners.
If Thats the case then why did the AIB and Invocas not send me a breakdown of there costs when i requested it, it was my money that they had and were dealing with, surely i should be informed where it is going, its funny that all seamed to match to the exact penny, but no breakdown was ever supplied,
How can they get there estimated fees so wrong, if i gave an estimate to a client and then hit them with a final bill for 3x as much without a breakdown , i'm sure that they would not pay up, unfortunatly in this case, it is Invocas who are in control of my money,
Can i ask the question, where do you think that Invocas sustained more costs that what is on this forum, highlighted 'TRUST DEED FEES', Where the maximum is around 4k, From speeking to other people, my case was no different from any other.
Your thoughts as a Trust Deed expert would be much appreciated.

Hi alex2258.
Please understand that I'm not taking sides. Part of my role as administrator on the site is to balance forum threads with information that might also be relevant.
I think you are entirely entitled to a copy of the fee breakdown from your trustee.
Other than the fact I'm still waiting for Invocas to discharge me as a result of EIF's crap behaviour over an unauthorised PPI claim, I haven't had a massive problem with them. I got discharged within a couple of months of my final payment, did all my statements on time and kept emailing them for info all the way through. Granted, the whole trustee discharge is a pain but there isn't really much I can do about that other than keep asking for an update. I had a massive amount of debt (all of it my fault) so I'm grateful for them facilitating me sorting that problem. Hope you get it all sorted out.
Nothing left to discharge - everything's done and dusted!
Hi (my first post!)
Alex, you can submit a Data Protection Act 'Subject Access Request' to either Invocas or AIB and ask for all personal information they hold on you - they have to provide it by law, and the maximum they can charge is ยฃ10.
I'm with Invocas, and my last payment is due 1/1/13.
Jengis
It's now three weeks since I was told by Invocas that my discharge papers had been signed and were on their way. Excuses:
Week 1 - actually they haven't been signed and the Trustee has been on holiday but they are on his desk for signing. Nothing received.
Week 2 - the Trustee has been sick all week but will definately be back on Monday and sign the papers (also told that person I am dealing with is off on annual leave and given yet another name of a person to contact) Nothing received.
Week 3 - Trustee is back and papers will definately be signed and with you by the end of the week.
Nothing has come through the post to date so will follow up yet again on Monday.
My Trust Deed was for 4 years and I never missed one payment and provided all information requested so have kept my side of the contract.
So so disappointed in Invocas.
i have recentley ended a trustdeed with Invocas and they are still taking payments from my account, this is the 2nd time in 3 mths that this has happened, 1st time round i got my money back but now they seem to be taking the piss. i havent received papers to say that the trust deed is finished or phone calls from them about signing papers to comfirm the end of the trust deed.
Stuart cant you just cancel the direct debit or standing order??
Paul
Trust deed completed Jan 2012,Trustee discharge Nov 2012.
A new dawn.
Hello Stuart and welcome.
Assuming that you are sure your payments have come to an end I think Paul's suggestion makes sense?
If you have a direct debit either you or Invocas can stop the payment. If it's a standing order only you can.
i have contacted them again and once again they will refund the money but was told that it can take months after the end of a trust deed for it to official be closed
