After 4 years of monthly payments from me and my civil partner our trust deed with Invocas finished in December 2012.We got in touch with them after a few months to find out what happens next,We were told that they were waiting to find out if there was any equity in our house. They decided there was none and asked us to pay another £5oo each before we could be released from the trust deed.I told them and have sent them proof that I have been unemployed for a few months now and we are living of my partners wage and I cant afford to pay this.Since then they have received a few PPI payments does anyone know where the PPI money went and why didnt they take the £500 pounds each from the PPI that they received.
Hi LiviLad
The PPI payments are regarded as separate assets from contributions and the £500.
There are a few posts o the forum in relation to these £500 payments. Sometimes it's £500 for a single trust deed, sometimes it's £500 for a joint trust deed, sometimes it £500 each!!
You will need to check and see what was agreed at the start as it may be that the trustee ( incredibly!) won't discharge you until the payment is made.

Thanks Mark I have contacted them re my unemployment but still waiting on a reply.
Hi LiviLad
Hopefully they will review matter and decide that they can proceed to close.
Keep us posted.

Ah Kevin! there's that word sensibly again.
If you're like me, very little surprises me on the forum. normally balance and logic should/would apply and hopefully it does in this case.

My thoughts exactly Kevin but I am still waiting for a reply from them I had to send them a copy of my P45 to prove I am unemployed.I think they are stalling so they can claim any other PPIs that might come along.I just wish I could get help from somewhere else im soooooo angry with the situation.Job hunting is stressfull enough.
Hi LiviLad
Its surprising that they have waited this long to start pursuing it. Also, there should be no reason why they can't discharge you and they stay in office to conclude any PPI issues.

Its just the £5oo each I dont think they will accept my situation and will push for payment.Do you think I can put any kind of complaint in against them?
Hi LiviLad
Probably not if it was agreed as part of the Trust Deed proposal at the start of the case.

Hello again. After I sent a few emails yesterday I finally got a reply and a scanned copy of a letter from Invocas. They say that we dont have to pay the £500 that they wanted from both of us (HAPPY DAYS INDEED).The letter says they have passed our file to the closure team to process our discharge pending any outstanding PPI investigations. In effect this will result in the trust deed being kept open to finalise such investigations, albeit we will receive our discharge.I see this as a small step forward but do you know if is this is normal and if so how long does it take.
Hi LiviLad
Great result. Really pleased it has worked out and you can now look forward without this hanging over you.
Make sure you keep on top of them with that discharge!

Cheers Mark but frustration has now led to anger.Payments ended last December and its still ongoing.I have contacted the judge (Sunday Mail newspaper) and I am now going down a complaints route.Might not get me anywhere but for my own health reasons its worth a try.
Whilst your frustration is understandable and it sounds as if Invocas could have been much more pro-active with regards to having your file ready for closure at an earlier stage surely starting to wade in with complaints will not be of a benefit to your health problems.
I know when a relative of mine were having to make serious complaints with regards to her employer, the level of frustration and consequent health concerns grew rapidly.
Bear in mind as well that whilst trustees have a duty of care, they are ultimately in place on behalf of creditors and to recover as much as possible for those creditors. I'm sure they would rather have cases closing on time too but it is now an obligation for Trustees to carry out the PPI checks.
Thank you for the comment and I do agree with you but the fact that its taken 10 months so far and still no closure has taken its toll.I have told them my feelings and I appreciate their help but when does it all end.
