I was offered the trust deed option in 2009 and wish i had agreed to it, would have been free by now. The main reason i did not though was i was not sure if going into a trust deed would prevent me from renewing my UK visa or remaining in the UK indefinately. I just started new talks about entering a trust deed and want to know if it might have a negative effect on my immigration status. Thanks
Hello sigario.
I don't know enough about immigration processes to offer a view I'm afraid.
Is there any kind of advice line in connection to UK immigration where you could ask questions without having to provide your name?
unfortunately dont know of any.
contact your local citizens advice bureau,I am sure they can help if you struggle to get anywhere with the border agency website.

It takes ages to get a response from UKBA. Sent them an email once around June last year and got no acknowledgement or reply. will take both your advise though and see how i get on. Thanks a lot
I have had a look through it and by the looks of things as long as you have maintained tax payments(so not avoided the taxman),and didnt deliberately become insolvent,it shouldnt affect any visa application but it does say that things would be looked at on a case by case basis. I would want a definate asnwer to the visa question before signing up to anything. Sorry I cant be of more help.

i just gave UKBA a call and they had no clue if it would have a negetive impact on me (believe it or not) I was advise to arite to the croydon office so they have investigate and give me an answer. No chance of that, might as well be digging a hole for myself
Dont be too hasty. If you are only asking the question then they cant hold it against you. How long does the visa last?

Not quite an hour, but never mind! The solicitor says there is nothing in the legislation which states that a trust deed would prevent your visa or settlement application. However, she also said that they do look at your financial stability when applying for settlement, eg. If you are working you are more likely to be allowed to stay than if you were on state benefits. The decision then lies as to whether you simply have debt, or have taken voluntary steps to sort it - through the likes of a Trust Deed. As each case is taken on its own merits, she said there cannot be a guarenteed answer.
I think it is better to have addressed the issue, and if you don't want a Trust Deed, would the DAS be a possibilty in the meantime? How much debt do you have, and roughly how much is your disposable income every month?
