[:(]Hello hope everyone on the forum is fine I,m really worried now, I have a trust deed with Begbies Traynor which I took out in August 2007 due to a Issue with HMRC which has been ongoing since August last year they say I can not be Discharged, I have phoned every month to see what the state of play is and seem to be getting nowhere, I said to the lady on the phone "well at least by August 2013 all my Defaults will of dropped off my credit file if i am not discharged by this August" She stated this is not the case and they will not be removed from my credit file until my trust deed is Discharged, I find it totally unnaceptable that they have waited all those months and not bothered to chase up HMRC it,s simply not fair I am soooo stressed out over this couldn,t care less attitude. I also wrote to B T s and never even got a reply!!!!!

Please try not to worry too much. By posting on the forum hopefully we can put your mind at rest a little.

Can I ask, have you fulfilled your agreement? Have all contributions been paid and all assets realised accordingly? I understand that HMRC, being your largest creditor are holding up the closure of your case as they have not submited an acceptable claim? This seems strange as they are usually the best creditor for submitting claims. Unless the Trustee has an issue with the claim that allows them not to be in a position to agree this.

Notice of the Trust Deeds incorporation generally stay on a credit file for a period of approximately 6 years. The individual creditors remove themselve from the credit file at the end of the Trust Deed, usually when they receive a dividend. Even if it is not 100p in the ยฃ, it is treated as fully satisfied, and the debts are written off.

Thank you for your reply Bob, Yes I have paid to Begbies Traynor all my house equity fulfilled all my payments and they have recieved all PPI this all happened 2 years ago, they state they are waiting on a large payment from HMRC once they recieve this they say I may be Discharged then. It has been going on for months and months and I was hoping for it all to be over and my credit file to be sorted out by August I just feel they don,t care.

Hello lissybladey.

Because your trust deed was signed before April 2008 the trustee cannot easily discharge you before all matters connected to the trust deed have been completed.

This issue with HMRC and VAT has caused many genuine difficulties for trust deed providers. Clients signing trust deeds after April 2008 can be discharged while they are resolved. Sadly this doesn't apply to you.

Of course, none of this is your fault. I think anyone reading this would consider that this is quite unfair on you given that you have completed your responsibilities. It's almost certainly not what your trustee would want either, to some extent their hands may be tied at the moment in the circumstances.

On a more positive note, the information you were given about default notices is incorrect. Anything that goes on your credit file drops off after six years, discharge or not. The issue may be more that outstanding balances might still appear there for the debts that were in the trust deed.

Thank you so much Amy I will just have to live in hope they sort it out soon, the forum is a great means of gaining advice and makes you feel less alone in these situations knowing you are not the only one and that you guys do care.

The HMRC issue was a pain for all firms, however we managed to resolve this sometime ago to allow for discharges to take place. I understand most firms are now in that position.

Best advice would be to keep on their back until it's resolved.
