Help! Bank set off ?ú2,000 cheque

Hi i am in a protected trust deed and recently recieved a cheque for £2000 for a equal pay claim i made 5 years ago before my trust deed, i put the cheque into the bank and was told it would clear today, to my shock and horror the money was not in today and it appears the bank has "set off" the money to pay for debts on accounts and credit cards that are already part of my trust deed. can they do this? i wouldnt think so as the debt has all been tied into my trust deed if not how can i go about getting my money back? i know the money has to be declared to my ip and i was going to do this today and hopefully get them to leave me with about 25% of the money as my toilet urgently needs fixed or am gonna be left without a useable toilet in the flat

Hi Barrie

Because of the Trust Deed, the bank have no right of set off. I think if you advise your Trustee, he will be able to sort this for you.

I would very much expect the trustee to want a large chunk of the value of the cheque. Did you not change bank accounts to one you had no debts with at the start of your td?
