In trustees got 1500.00 as a gift to pay my overdrafts off but been told I should not have accepted it as I should have gone to my trustees is this correct??

That should read trust deed not trustees

Hi Yvonne

Your overdraft is a creditor like all others in the Trust Deed. However a third party is able to do what they like with their money and if they choose to pay one creditor and not the others, then there's nothing the trustee can do about it.

Welcome to the trust deed forum yvonne66.

I assume this was a new debt accrued after your trust deed began?

This is really a question to put to your trust deed firm. Your trustee may possibly let the matter rest if someone gave you the money specifically and only for this purpose.

If they feel that it was money that you may have received anyway then it's more likely that they'll see it as a windfall that should have been paid over for the benefit of all of your creditors.

You'll really need to see what your trustee has to say on the matter.
