The reason that I am in a td is due to a gambling problem. I have no assets and entered the td with about 10, 000 of debt. I am now struggling emotionally, I have been on courses of anti depressants but I am on top of my problem. The issue I have is that my mum lent me money before I entered the trust deed in order to pay of some of the debt, now she has been made redundant she needs money back from me. I am now faced with the dilemma of what to do? In paying my mum and the td each money I am left withababsolutely nothing. Is this something my trustee could help me with? Could my td come to an end quicker as the financial pressures are making my physically ill? My doctor would be more than willing to write me a letter. Any advice would ve great.
Hello weewillamena. I'm sorry to hear you're having a tough time at the moment.
If you're feeling unwell and/or vulnerable at the moment you should consider letting your trustee know so that they can take this into account when communicating with you.
It's important to remember that you appointed your trustee to work on behalf of your creditors as well as you. In terms of the trust deed I suspect they'll want to ensure that your creditors continue to be treated in line with the agreement you offered to them. I think it would be very difficult or impossible for them to facilitate the repayment of debts to a relative in preference to the creditors in your trust deed.
There's never any harm in running a situation like this by your trustee to see what they say, but you may find that you have a choice to make about whether to carry on with the trust deed as originally agreed or to risk having to find a different way forwards if you choose to prioritise your money towards making payments to your mum.
Have you tried explaining your situation to your mum, weewillemena? I understand she is struggling herself at the moment, but surely she wouldn't want to see you making yourself ill?

If you stay with your Mum, then it could be argued for a reduction as you would need to contribute more to the household expenses, unfortunately if you don't the Trustee and the creditors would see any payment as a payment being preferred to one creditor against another and I suspect could not allow for a reduction.
