When a Trust Deed is finished do you receive a copy of the final accounts?
My original debt was ?ú37,000. I paid ?ú100 each month for 3 years. My house was sold and ?ú63,000 went to my Trust Deed. According to my Trust Deed all my debts were paid and after fees there is no money left. Is this usual? I'm confused. I have tried on several occasions to speak to my Trust Deed but he is never available and does not return my calls.
Thanks
KT
Hi KT67
I'm surprised that Your Trustee can't provide a Receipts and Payments.
It looks like there was sufficient to pay everything in full as the Trustee needs to settle the debts plus interest on the debts and fees.

Hello kt67.
On first sight of these figures it would appear that the level of fees is pretty high. Obviously I'm unaware of any extenuating factors that might apply. Have you been told the actual level of the fees charged?
You can request that this information is supplied to you by your Trustee.
My understanding is that you can then ask the Accountant in Bankruptcy to audit the case if you dispute the level of fees charged for managing your trust deed.
Thanks for replying so quickly.
As I said, I have tried to contact my Trust Deed but he does not return my calls. This has been an ongoing issue for the past 4 years!
How long does it usually take for the final accounts to be drawn up? Should they come out automatically?
Thanks
KT
Perhaps you could write a letter (personally addressed to your Trustee) demanding that these details are provided to you within a fixed time period (perhaps a couple of weeks) or that an explanation is given to you why this cannot happen currently along with an estimation as to when this will happen.
Ultimately you have the option to issue a formal complaint to the Trustee (and subsequently his/her regulators) but I do hope that this will not be necessary.
Hi kt67
A copy of the circulars that are sent to your creditors, which includes a receipts and payments account, should also be sent to you.
As TDA states I would suggest that you send a letter to your trustee, by recorded delivery, asking him to provide the requested information within a couple of weeks. If the information isn't provided within the relevant timescale you could then write to your Trustee once more advising that he has a further seven days to respond before you complain to his regulatory body.
Hopefully you will get the information that you are looking for without having to take this any further!

I just received my accounts today and I'm very confused.
On the account breakdown he has stated his fees are ?ú1175 plus outlays of ?ú446.50. On the statement his fees go up to ?ú4465. There is also a payment to my ex-partners Trustee of ?ú5978.85 plus interest making the final payment to him ?ú7719.70. I know this other trustee dealt with the sale of the property but should this amount to ?ú7719.70? I'm so confused:-s
I thought it would only be my debts that were paid off with interest. How can he make a payment, with interest, to anyone I don't owe money to?

Hi kt67.
Forgive me if I'm being a little slow, but are you asking why your Trustee has made a payment (plus in interest) to the Trustee of your ex-partner?
Was your ex-partner a co-owner of your home that sold?
