Equity in car

Hi, I am due to complete my trust deed in December (extended for 4 months due to missed payments). I expect it to be extended further however as I have equity in my car. Please can anyone tell me if I have any alternative options, can I sell the car to gather in the equity or hand it over to my trustee? I'm spending money on it almost every month and its no longer sustainable.

My car loan with Santander is part of the trust deed and if I try and sell it I suspect it may show up outstanding finance/loan against it.

Hi prenticebaby.

Talk to your trustee, they may well prefer a sale to an extension.

If the Santander loan is in your trust deed finance will not be registered against the vehicle.

Thank you. It appears strange but last year I enquired about trading my car for one of the same value and the dealer carried out a search on my cars registration and identified that the car had outstanding monies owed against it.

I've seen that a few times, where finance companies have registered the debt against a vehicle when they shouldn't. Maybe it is just an administrative error on their part, or perhaps a deliberate policy. Either way, unless the finance is Hire Purchase/Conditional sale/PCP then the debt is not secured against the car.

If Santander have incorrectly registered finance against your car you should certainly demand that they correct that prenticebaby.

we dealt with the sale of a car recently with almost identical circumstances, however we used an agent to sell the car and this seemed to go through no problem.

The registration showed outstanding finance, however I assume they carried out an HPI check and this confirmed that the debt was not secured against the car and the sale went through with no issues.

If you are looking to sell it yourself, i suspect the best idea would be to get Santander to update their records, however I wouldn't hold my breath on them rushing to do this.

Thanks for taking the time to reply. I'll write to them and ask them to look into it. I wouldn't hold my breath either, they were hopeless when I did pay my debts so don't expect much now!!
