phoned my trustdeed yesterday as the 48 months is almost up i have wrote various times to them and phoned about my husband and i seperation they really have taken no notice of this we are both in a trustdeed at the start the house value was alot higher than now i had a valuation done and it but came in at £10000 less equity told them this various times aswell but yesterday i asked whats to happen they agreed that no lender will remortgage and its very unlikely il get a loan so they then asked me how are you going to get the money when i again told them about the equity again there response was like well thats what you have to pay at the end how are you going to do it im worried sick my exhusband has moved out i live in the house which i dont want to sell i did ask them a while ago if i could make an offer of a lower amount there answer was that they would look into it and send out a letter never got a letter i feel that when we sighed 4 years ago they made it sound so simple i pay £120 a month my exhusband paid £200 and we remorgtage at the end can you advise any help

Was there a specific amount of equity you committed to at the start of the trust deed?
How much do you believe your property to be worth if you had to sell it quickly now?
How much remains outstanding on your mortgage and any other loans secured upon your home?
Is the home still jointly owned?
Sorry to ask so many questions but the answers will help the experts to offer their thoughts to you.
they wanted £25000 at the end,this was to be splif equally between my exhusbands and my own trustdeed it actually ment that i was paying back more than i was owe , at the moment for a quick sale prob be around £89000 still have £75000 on mortgage yes still jointly owned

prob my son would help me he still lives in the house i thought about £8000-£10000 as if they force me to sell the house by the time the agents fees came off this would prob be close to whats left to be split between both trustdeeds i have spoke to them about this but once again no answer dnt think they relise how stressful this is they made it sound so easy 4 years ago to be able to just remortgage and that would be that

I would suggest putting the offer to your Trustee in writing, explaining how it would be paid, when it would be paid and by what means. Hopefully they will accept a reduced offer rather than try and force the sale in the current climate.

Given that they would not get more funds from selling your home - and potentially MUCH less given the fees involved in forcing a sale - then I would be surprised if a deal couldn't be done here as you suggest.
You need to keep on at them until they give you an answer,I think. It must be very frustrating being kept dangling! Maybe you could organise to meet with your trustee and talk it through face-to-face?
thanks for your help i have wrote to them and offererd them a reduced amount and explained about the sell off the house and fees still no reply i even emailed them they just dont seam to want to give me any answers and i dont want to go ahead arranging a lump sum and involving my son if there answer will be no do you think if i write again or phone ,im sure this month is our last payment they couldnt even tell me that

I think it will be best to keep chasing them up sallymilne until you get a proper response.
This must be very frustrating for you but please be persistent, you have paid them thousands of pounds in fees for your trust deed and are entitled to a degree of service and responsiveness.
