Ebay Income

Hi

I'v now been in my Trust Deed for almost 16 months and really struggling financially.

Because of my financial position becoming worse through leaving my job to care for my mum-in-law last April, I managed to get my TD company to reduce my monthly payment to them. They said it was temporary and would have to be reviewed but as they did not get back in touch, I assumed everything was fine.

Four/five months after having my payments reduced, they have since written asking why my payments had not increased again, asking for a fresh Income and Expenditure form from me along with last 3 bank statements as apparently my reduced payments were only meant to be for 3 months after which it was to be reviewed. I told them they did not tell me this in writing therefore how could I remember? They said this was their error, I should have been told in writing and not just by phone.

Now I'm not sure how others in PTDs cope but I have to say that in order for Christmas to happen in my household my partner and I threw ourselves into selling our old vintage band t-shirts on Ebay (lots of stuff we would rather not have sold)to pay for the kids' Christmases and made a few hundred pounds. Also, on top of that, I took an interest free cash loan from my student son (he's better off than us!) which I am now trying to pay back slowly to him every month. I never once thought to let my Insolvency Practioner know about this - it just didn't enter my head that income from Ebay should have perhaps been disclosed. Can you tell me if this was wrong? Can I sell my own personal items on Ebay to generate spare income and must I disclose this to my PTD company? It's my partner (who isn't included in the PTD) who does the actual listing/selling etc but it's my bank details that are used so obviously I worry about this. It's very irregular so hard to list on a monthly Income and Expenditure form. I have listed it on the one I've just sent them but mentioned that it was not regular income - I also mentioned the expenses of Ebay/postage etc.

I really desperately want to gain extra spare cash as my young daughter is the only one in her class who hasn't been abroad which she mentions sometimes and this gets me so down therefore I'm determined to make some cash to get her a proper holiday this year (still have to find money for the passports first!). Not sure I've much personal property left to sell but would like to try. Is it wrong of me when I have creditors? Are you even allowed to go a foreign holiday when in a PTD?? These are the sort of questions I never thought to ask before I entered one, although I know I still would have had no option but to go down this road.

Any advice would be gratefully appreciated. I started off this PTD with so much hope for the future, but the struggle to cope whilst in it is really taking it's toll on me, my partner and my children. Am I alone??

Hello betterlife.

A trust deed doesn't have rules preventing you from taking a holiday or travelling overseas.

The eBay question has arisen here before. I think the general feeling from the experts was that if this were a fairly irregular activity, rather than a fairly common part of your "business", that a trustee was unlikely to take an interest in the proceeds.

Unlkess the ebay income provided a material difference in your monthly income, then I would be surprised if your trustee had any interest in this.

The Trust Deed and especially the Trustee should encourage you to move forward. If a contribution has been agreed, then what you do with any other income should be your own business.

The items are definitely personal but you could say we had made a profit on the t-shirts as a couple of them sold for over a hundred pounds (only worth what a collector will pay for them). This is slightly different to our other ebay sales which are used dvds/old clothes/video games. We were hoping to try and sell stuff every week if possible. Before Xmas we were constantly selling for the best part of 2 months. Since Xmas we haven't had any Ebay activity but now we are back on track to make some extra cash. Would you class this as regular or irregular activity?

Personally, I would have no interest in this. If its items that the Trustee would not otherwise have an interest in, then I can't see them having an interest in them now.

If you sell your microwave to buy a George Foreman grill, then it falls as the same argument.
