Disposition Form

Good Morning,

I am in the process of putting my house up for sale. My ex partner is currently in a PTD, but I have confirmation that £500 has been paid, resulting in her trustee having no interest in the property.

Everything is in order, with my Lawyer advising that a disposition form will be sent out by my ex partner's Trustee, allowing me to market the property. That was , However, over two weeks ago and i have heard nothing. To cut a long story short, the house, in error, temporarily went on the market and there is a list of 4 potential viewers already. Because of the aforementioned condition, i am stuck in limbo until i receive fhe disposition form. Does anyone have experience/knowledge on how long this form is likely to take to arrive? I'm concerned if it's not here soon then these 4 potential viewers will soon become none.

Any experience and or advise of these disposition forms would be greatly appreciated.

Hello Rover1983.

As an aside, do you expect that there will be any equity generated by the sale of the property?

Hello Trust Deed Assistant,

I'm not sure at the moment. There might be some marginal equity but it will depend on what it sells for. On a good day there might be 5k, on a bad day there might be none at all. Can equity still be pursued even although this £500 has been paid?

The £500 usually applies to a property that isn't sold.

As I understand it, where a property is actually sold the trustee might be obligated to collect whatever share of the equity applies for an individual that is in a trust deed.

Is the disposition from your ex-partner's trustee is to transfer the property into your sole name in return for the £500 payment, Rover1983? If so, then once that has happened then you needn't worry about them getting any further money from any subsequent sale as the house would be solely yours to sell.

I would certainly chase them up though to make sure it happens as soon as possible.

That is exactly right. Sorry, my post maybe wasn't too clear. I will chase this up.

Hi Rover

It's a wee bit more complicated as the property is being sold, however if the money has been paid and the Disposition sent then I see no reason why this should not be signed and returned immediately.

Hopefully the Trustee will not take the view that this will be signed at the end of the Trust Deed.

Thanks for your response Mark. I'm pleased to say that the Disposition form has been signed and returned, the house can go up for sale and the trustee will not pursue any equity.

Now the simple bit of trying to sell the house.......
