my long divorced husband was granted a trust deed in 2004 and tells me it is not yet discharged. how long does it take ? we have a joint insurance policy which was and is intended to help our daughter, it is due to mature in 2011.I am worried about how to protect it.

If it was protected and over a 3 year period, then i'm amazed it is not finalised. I would have expected this to be wound up at least 1-6 months after the final payment.
As for the policy, if it existed prior to the signing of the Trust Deed, then it is regarded as an asset of the creditors.

I am surprised ( or again maybe I'm not) that this has went on for 6 years. The Trustee really should have made a decision which is sequestrate for non compliance.
Your interest in the policy is protected as only his half share vests in the Trustee. On surrendering this, you would need the Trustee's signature on behalf of your husband.

You could do an online check with the Edinburgh Gazette to see who his Trustee is and call them or call the Accountant in Bankruptcy's office.

In addition you can check the Register of Insolvencies on the Accountant in Bankruptcy's website. This is a public record and if you register you can get free access. This will tell you if the Accountant in Bankruptcy have any record of your ex-husband's trustee receiving their discharge.
