Hi, I had a trust deed which ended in 2010. I now have the opportunity to enter into a company as either a director or shareholder or both, just in the discussion stages really but I was unsure if any of these options are ok for me with me having a trust deed previously. Is it likely to crop up in any searches as I don't really want to admit to the other people involved that I got myself into a mess financially a good few years ago? Thanks in advance!

When did you sign your trust deed? It will no longer show on your credit file six years from the start. That may only be relevant if you have to form part of an application for borrowing by your company though.

A public record of it almost certainly still exists on the Edinburgh Gazette. I guess the question there is who would want to go looking and would they know where to look.

You can be a shareholder and/or director during or after trust deeds.

I suppose there's 2 parts to this. Firstly there is no restriction in you being Director or Shareholder in or out of the Trust Deed, however secondly it will depend who would be likely to carry out a credit check for the prospective apointment.

It may be as Director/Shareholder that you would be signatory to the company bank account which may require a credit check, however apart from that I can't think of another reason for carrying out such a check.

I'd be surprised if it caused you any problems, asterix. it shouldn't show on your credit file or the register of insolvencies any longer so it is very unlikely that they would ever know (unless I suppose the bank the company uses was a creditor of yours previously?)
