Default on credit file

Hi

I was finally discharged from a protected trust last summer. My wife refused to enter the deed at the time. We did build up a significant overdraft with a bank which was subsequently accepted into the trust deed. The trustee paid the said bank a dividend at the end of the deed and the balance has reduced. The problem is that this company have flagged my wife's credit file with a default for this joint bank account. This still showing as default.

1. Can they still pursue for the remaining money?

2. Do I need to approach them and get this repaid so they settle the account for her on the credit file. It defaulted on 27 Sep 2006 and has shown as defaulted ever since, will it fall off the file in 2012?

Hi Jabber

Yes, if the debt is joint, the bank can pursue your wife for the full balance.

Probably best to speak with the bank and arrange payment to show this as satisfied.

It is possible that they might just write the debt off and it would just disappear off her credit file after the 6 years. No guarantee they won't try and recover the debt from her though.
