Hi all
Just checked my credit report and have received a default notice for an old account which was covered in trust deed which was signed in june 2011 with TD being completed june 2014, is the allowed from Bank of Scotland and can I dispute it? If so any idea where to start?
Also checked all closed accounts and most of them have defaults right up until 6 months after trust deed was completed in 2014, should they be back dated to when trust deed was first started?
Just trying to get all my financial information organised so everything will be in order after the 6 year period from signing my trust deed is finsihed, any help/advice is appreciated
Regards
Hi Jock
Yes. All defaults should be matched with the date of the signing of the Trust Deed (or very shortly after).
You can contact each creditor, provide them with a copy of your Form 5 discharge (which shows date of Protected and Date of discharge) and ask them to correct your record to Date of Signing and mark Satisfied or Partially Satisfied - in accordance with the Data Protection Act.
It can take a bit of time depending on how responsive they are. If you have a few problems ask to raise a complaint.
My recommendation is that you keep a record of all dates and times of calls, who you spoke to and what they said - for each creditor. Some are more responsive than others. Some are English and not familiar with Trust Deeds so you have to guide them.
You can start by contacting the Customer Services Department, although in my experience it is 'debt resolution' or 'defaulted accounts' department that deals with it.
It is your right to have your files corrected. Good luck!
Thanks Firewalker, much appreciated. Looks like I have quite a few phone calls to get through!
