Default applied after start of Trust Deed

Hi!

Looking for some advice on defaults on my credit file and when these can be applied.

My Trust Deed was signed in July 2019 although my first payment ended up being in November 2019. I made my final payment in February 2024 and was discharged in April so I've been keeping an eye my credit file steadily improve.

I've noticed that one of my creditors applied a default in September 2020 which was clearly after my Trust Deed became protected.

Is this allowed to happen as my understanding is it shouldn't be. My trustee are basically saying the creditor can apply the default whenever they like and not looking like they'll do anything about it.

I'm hoping I can get this sorted as all my other defaults and Trust Deed are due to drop off this year so would be frustrating if there's one default remaining until next year.

  • Hi Cemcr90, I can understand how frustrating that must be. I think the advice from your trustee is correct. However you could try engaging with the creditor directly and seeing what they can do to help. I believe there are templates that someone might be kind enough to share that can help with how to approach the credit card company

Hi Cemcr90,

 

There is a thread with more detail on this from 5 months ago, titled "Incorrect default dates".  I posted some help in that on how to go about sorting this. Long story short though -  the Information Commissioner's Office is clear in that the default dates should be no later than the date your TD was signed (not when it became protected).
