My sister has just died very suddenly, and my family have discovered she had a deed in trust to cover debt. I came across a letter saying she had made the last payment and was now discharged. She did have a NHS pension which we thought would go to my parents . However my parents have just received a letter from a credit card saying she owes money and they will take it from her pension. How can we find out who managed the deed? And how can she still owe so much? As far as we read from this one letter if discharge all debt had been paid.
My parents are retired and already have the financial burden of the funeral costs .
Any advice would be welcolme as I am oversees and my parents have no paperwork.

Hi Scotinus

Do you know if the credit card was included in the trust deed. If so then it is a debt under the trust deed and nothing more.

I can't see any way the creditors could obtain payment from the pension. If there is a lump some it may well be that the debts of the estate need to be satisfied first, but probably best to get legal advice. I think it's unlikely to be honest, but a pensions expert may be the best person to contact.

Hi scotinus, so sorry to hear about your sister. If you want to find out who was administering the Trust Deed for her, then go onto the insolvency register- it is a public register. It will tell you who the trustee was, and they will be able to help you.
